MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON November 29, 1990 <br /> FOLLOWING MEMBERS WERE PRESENT: Arts, Harvey, Quackenbush, Kruschke. <br /> ALSO: FleckIReynolds. <br /> Meeting called to order at 7:02 P.M. in Room #2E City-County Building, by <br /> Chair Kruschke, to hold public hearing as published by Class II Notice. <br /> Harvey/Quackenbush to approve minutes of 10/25/90 and 11/27/90. Motion <br /> carried - 4-0. <br /> #2062. Appeal by Glen Bestor for a variance from required setback from normal <br /> high watermark and maximum height of accessory buildings as provided by <br /> Sections 11.03, 10.07(3)(b) and 10.16(6)(a) to permit boathouse construction <br /> at 2186 Colladay Point Drive being Lot #15, Colladay Point - Section 23, Town <br /> of Dunn. <br /> IN FAVOR: G. Bestor OPPOSED: --- COMMUNICATION: --- <br /> Quackenbush/Harvey to grant variances of 2 feet from required setback to <br /> normal high watermark and 18 feet from maximum allowable height of boathouse <br /> above normal high watermark to permit construction of boathouse as proposed. <br /> FINDING OF FACT: <br /> 1). Applicant has withdrawn requested variance for deck/observation platform <br /> and opted for deck on top of proposed boathouse. <br /> 2). Structure is set into and upon a bedrock shelf and no practical <br /> alternative. <br /> 3). Top of boathouse is allowed retaining wing wall to be used to stabilize <br /> bank. <br /> 4). Property has extremely steep embankment with 30 foot drop to water. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> #2063. Appeal by Fuchs, Inc. for a variance from required setback from road <br /> as provided by Section 10.17(1) to permit fuel island canopy and fuel tanks at <br /> 7257 STH 78 in the SE 1/4 SE 1/4 - Section 13, Town of Mazomanie. <br /> IN FAVOR: T. Ramaker, L. Anderson OPPOSED: --- COMMUNICATION: Town <br /> Board. <br /> Harvey/Quackenbush to grant variance of 40 feet more or less from required <br /> setback from centerline STH 78 to permit fuel storage tanks, island and canopy <br /> as proposed. <br /> FINDING OF FACT: <br /> 1). State requires abandonment of old fuel storage facility. <br /> 2). Tanks and island constructed without County Zoning Permits. <br /> 3). Structure is located satisfactorily in accordance with D.O.T. <br /> requirements. <br />
