MINUTES OF THE MEETING OF THE DANE COUNTY <br /> kJ BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON December 17, 1992 <br /> The following members were present: Lynch, Quackenbush and Gaskill. <br /> Also: Schutte, Fleck and Reynolds. <br /> Meeting called to order at 6:30 P.M. in Room 2E by Chairman Quackenbush to <br /> hold public hearing as published by Class II Notice. <br /> Minutes: Lynch/Gaskill to approve minutes of 11/12, 11/19 and 12/10/92. <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2270. Essert - Westport - 6/25/92 P.H. <br /> Gaskill/Lynch to hold appeal until February Hearing as per request of <br /> applicant - No further abeyances without specific plan and time-table for <br /> completion. <br /> Motion carried - 3-0. <br /> #2273. Withdrawn by agent. <br /> #2328. Frey - Roxbury - 11/19/92 P.H. <br /> APPEARANCE: M. Frey <br /> Gaskill/Lynch to deny requested Variance from required setback to centerline <br /> of Lueth Road for proposed accessory building. <br /> FINDING OF FACT: <br /> 1). Applicant had amended requested Variance from 10 feet to 5 feet by <br /> narrowing size of requested building. <br /> 2). Applicant has 3 acre lot with moderate slope toward road. <br /> 3). Proposal is to locate storage building between septic field and 20 foot <br /> ingress/egress easement granted to neighbor. <br /> 4). Structure to be utilized for equipment storage and vehicle unable to fit <br /> in residence garage. <br /> 5). Presently 2 smaller accessory structures on property, located in <br /> complying locations. <br /> CONCLUSION: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried - 2-1. Quackenbush, no. <br /> #2231. Endres - Roxbury - 11/19/92 P.H. <br /> APPEARANCES: L. Endres, M. Frey <br /> Gaskill/Lynch to grant variance of 1.5 feet from required 10 foot minimum left <br /> sideyard to permit garage expansion as proposed. <br /> FINDING OF FACT: <br /> 1). Applicant had amended requested Variance from 3 foot to 1.5 foot in order <br /> to minimize variance. <br /> 2). Presently residence has small single car attached garage and proposal is <br /> for additional garage width and storage. <br /> 3). Lot is 86 feet wide and tree in rearyard and limits building areas. <br /> iiipi 4). Adjoining property to South has potential to become road right-of-way if <br /> development occurs. <br /> CONCLUSION: <br /> 1). Variance is necessary to provide right enjoyed by others. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 3-0. <br />
