MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON November 19, 1992 <br /> Nov <br /> The following members were present: Quackenbush, Dreps, Gaskill and Lynch. <br /> Also: Fleck, Schutte and Reynolds. <br /> Meeting called to order at 6:30 P.M. in Room #2E by Chairman Quackenbush to <br /> hold public hearing as published by Class II Notice. <br /> MINUTES: Dreps/Lynch to approve minutes of 9/24, 10/15, 1992 and amend <br /> Minutes of 10/22/92 RE: #2299 (should be Town of Windsor) - approve as <br /> amended. Motion carried - 3-0. <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2273. City of Madison - Westport - 6/25/92 P.H. <br /> (No appearances). <br /> Gaskill/Dreps to hold in abeyance until December Hearing. Motion carried - <br /> 3-0. <br /> #2276. Nguyen - Madison - 10/22/92 P.H. <br /> IN FAVOR: H & C Nguyen OPPOSED: --- COMMUNICATION: Town Board. <br /> Dreps/Lynch to grant variance of 5 feet to required right sideyard to permit <br /> 24' wide by 26' deep detached residential garage. <br /> FINDING OF FACT: <br /> 1). Applicant has small lot with no accessory structure presently on it. <br /> 2). There is large privacy fence constructed on right lot line so garage <br /> would not obstruct any view. <br /> 3). Garage is needed to store vehicles and personal possessions. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 3-0. <br /> #2309. Department of Natural Resources - Berry & Cross Plains - 9/24/92 P.H. <br /> IN FAVOR: S. Stewart OPPOSED: --- COMMUNICATION: --- <br /> Gaskill/Lynch to grant, with conditions, permit to fill and grade as completed <br /> within 300 feet of Black Earth Creek/Salmo Pond. <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Zoning Ordinance. <br /> 3). That there be filed with the Zoning Department of certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> FINDING OF FACT: <br /> 1). Project intent is to fill beaver holes to prevent injury to public users. <br /> 2). Disturbed area approximately 40' x 100' . <br /> 3). Area filled with black dirt, seeded and mulched is presently grown over. <br />
