Appeal by William and Nahldean Maher for a variance from required <br /> setback from road as provided by Section 10.17(2) to permit reconstruction of <br /> tornado damaged Ag-accessory building at 1304 CTH D (Storytown Road) in the NW <br /> 1/4 NE 1/4 - Section 8, Town of Oregon. <br /> IN FAVOR: W. Maher, L. Anderson, M. O'Brien OPPOSED: --- COMMUNICATION: <br /> Town Board. <br /> Dreps/Lynch to hold appeal in abeyance until December Hearing to allow <br /> applicant to provide Zoning Administrator with additional information. <br /> .Motion carried - 3-0. <br /> #2326. Appeal by SuperAmerica Group, Inc. for a variance from required <br /> setback from roads as provided by Section 10.17(1) and (2) to permit <br /> construction of canopy over gas pump islands at 6340 CTH CV (Lake Road) in the <br /> SW 1/4 SW 1/4 - Section 32, Town of Windsor. <br /> IN FAVOR: R. Mueller OPPOSED: --- COMMUNICATION: Town Board. <br /> Dreps/Gaskill to grant, with condition, Variance of 13 feet from required <br /> setback to right-of-way of STH 19 to permit canopy over gas islands for <br /> triangular portion of structure only. <br /> CONDITION: <br /> 1). A structure shall be removed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1). Applicant has reduced size of canopy by 1 foot so the majority of lineal <br /> distance meets required setback. <br /> 2). Encroachment is from right-of-way of intersection of STH 19 and CTH CV. <br /> 3). Proposal improves existing canopy constructed within 1 foot of <br /> right-of-way line under Variance #1226 (1/26/84). <br /> 4). Applicants have acquired additional lands and wish to expand and update <br /> existing facilities. <br /> CONCLUSION: <br /> 1). Variance is necessary to provide right enjoyed by others. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0. <br /> #2327. Appeal by Hometown Builders, agent for Robert Moren for a Special <br /> Exception Permit as provided by Section 11.05(3) to permit filling, grading, <br /> etc. , within 300 feet of Lake Kegonsa being Lots 8 and 9 Shadyside Park - <br /> Section 30, Town of Pleasant Springs. <br /> IN FAVOR: R. Meyer OPPOSED: --- COMMUNICATION: ---. <br /> Dreps/Lynch to grant, with conditions, permit to fill and grade, as per plan <br /> submitted, to provide parking area and drainageway after construction of new <br /> single family residence. <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work b performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> tire Section 11.05(4) of Dane County Zoning Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br />
