Noyce OPPOSED: --- COMMUNICATION: Town Board <br /> Dreps/Lynch to grant with condition variance of 2 more or less feet to <br /> required left sideyard to permit 16' x 20' addition to existing residential <br /> garage. <br /> CONDITION: <br /> 1). Proposed addition is to continue existing building line of garage. <br /> FINDING OF FACT: <br /> 1). Addition, by virtue of not having 10 foot separation with residence, <br /> requires 10 foot minimum sideyard versus 4' minimum with necessary separation. <br /> 2). Additional storage needed for vehicles and watercraft. <br /> 3). Property is in an area of numerous non-conforming structures many with <br /> similar variances granted. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 41, 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 3-0. Appeal by Michael Gerner for a Special Exception Permit as provided by <br /> Section 11.05(3) to permit filling, grading, etc. , within 300 feet of Lake <br /> Mendota in the NW 1/4 SE 1/4 - Section 6 South, Town of Westport. <br /> IN FAVOR: M. Gerner OPPOSED: E. Solner COMMUNICATON: Town Board. <br /> Dreps/Gaskill grant, with conditions, permit to fill, grade and retaining <br /> walls as completed and proposed. <br /> CONDITIONS: <br /> 1) . That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 4). Completion and certification deadline of July 1, 1993. <br /> FINDING OF FACT: <br /> 1). Project is modification of Special Exception Permit #1841 granted 4/27/89. <br /> Low 2). Portions of previous permit grant were modified and construct to lesser <br /> degree of incursion. <br /> 3).
