Appeal by Robert Crook for a variance from required setback from road <br /> as provided by Section 10.17(4) to permit entry addition to existing residence <br /> at 4476 Third Street being Lot #13, Block #4, Village of Windsor - Section 29, <br /> Town of Windsor. <br /> IN FAVOR: R. Crook OPPOSED: --- COMMUNICATION: Town Board. <br /> Gaskill/Edgar to grant, with conditions, variance from required setback to <br /> right-of-way of Third Street to permit entry addition to existing single <br /> family residence. <br /> CONDITIONS: <br /> 1). Encroachment shall not exceed the greater of 8 feet from front wall of <br /> residence or no further than encroachment of residence at 4468 Third Street. <br /> 2). The structure shall be removed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1). Entry addition will replace former structure removed due to need of <br /> repair. <br /> 2). Addition acts as an "air lock" to minimize heating and cooling losses <br /> when entering or exiting residence. <br /> 3). Property is in an area of numerous non-conforming structures with <br /> numerous variances. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 3-0. <br /> #2281. Appeal by Mark Gerhardt, agent for Joe Kalschuer, Jr.for a variance <br /> from required location of accessory buildings for livestock as provided by <br /> Section 10.123(7) to permit accessory building for livestock after lot <br /> division at 6918 Fischer Road in the NE 1/4 SE 1/4 - Section 22, Town of <br /> Springfield. <br /> IN FAVOR: M. Gerhardt OPPOSED: --- COMMUNICATION: --- <br /> Edgar/Gaskill to hold appeal in abeyance until August Hearing pending <br /> additional information. <br /> Motion carried - 3-0. <br /> #2282. Appeal by Connie Reuschlein and Dan Gaytan for a variance from <br /> required sideyard as provided by Section 10.07(7) to permit porch addition to <br /> existing residence at 208 Nygard Street being Lot #18, Hammersley Heights - <br /> Section 35, Town of Madison. <br /> IN FAVOR: C. Reuschlein, D. Gayton OPPOSED: --- COMMUNICATION: --- <br /> Gaskill/Edgar to deny requested variance from right sideyard to permit <br /> addition to existing residence as proposed. <br /> FINDING OF FACT: <br /> 1). Existing non-conforming residence is 4.5 feet from right sideyard and <br /> proposal is to continue existing building line. <br /> 2). There presently is an existing porch in need of repair andplan is to <br /> remove same. <br /> 3). Proposed structure is of substantial size, being 16' x 18' requested. <br /> 4). Relocation of proposed porch on residence, reconfiguration of dimension <br /> impr or even a detached structure could achieve desired enclosure without need for <br /> variance. <br />
