ORDINANCE AMENDMENT NO. 5391 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> VERMONT <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Vermont be amended to include in the RH-1 <br /> Rural Homes and A-2 Agriculture District the following described land: <br /> Part of the N 1/2 SE 1/4 Section 2, Town of Vermont described as follows: <br /> TO RH-1: Commencing at the East quarter corner of the said Section 2; thence <br /> West 1380 feet; thence South 390 feet to Moen Valley Road; thence East along <br /> Moen Valley Road 530 feet to the point of beginning; thence South 350 feet; <br /> thence East parallel to road 250 feet; thence North 350 feet; thence West along <br /> road 250 feet to the point of beginning. <br /> TO A-2: Commencing at the East quarter corner of the said Section 2; thence <br /> West 1380 feet; thence South 390 feet to the centerline of Moen Valley Road and <br /> the point of beginning; thence Westerly along the centerline of Moen Valley <br /> Road 1,050 feet; thence South 417.4 feet; thence West 208.7 feet, more or less, <br /> to a point which is 916.5 feet South of the NW corner of said SE 1/4; thence <br /> South 260 feet; thence N 85° East 800 feet; thence North 70° East 1,060 feet; <br /> thence North 450 feet, more or less, to the centerline of Moen Valley Road; <br /> thence Westerly along Moen Valley Road 530 feet, more or less, to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Any residence or accessory buildings constructed in the A-2 zoned area <br /> shall be located so as to provide a minimal encroachment into the <br /> cropland. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land.
