ORDINANCE AMENDMENT NO. 5395 <br /> Amending Section 10.03 relating to Zoning District- in the Town of <br /> BERRY <br /> The Dane County Board of Supervisors does •rdain as follows: That the <br /> Zoning District Maps of the Town of Berry be mended to include in the C-2 <br /> Commercial District the following described and: <br /> Part of the NW 1/4 NW 1/4 Section 10, To of Berry described as follows: <br /> Beginning 364.5 feet East of the Northw--t corner of said Section 10; thence <br /> East 453 feet; thence South 128 feet; ence East 165 feet; thence South 103 <br /> feet; thence West 618 feet; thence No , h 231 feet to the point of beginning. <br /> COND , IONAL ZONING <br /> Conditional zoning is hereby impo=ed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordin.nces. The rezoned area shall be subject to a <br /> delayed effective date subject o the following: <br /> DEED RESTRICTION REQUIRED <br /> The owner or owners of the and shall, within 90 days of approval of this <br /> rezone by Dane County, record the following restrictions on said land: <br /> A. Use of the property is limited to: <br /> 1. Repair of far-, tractors and motor vehicles. <br /> 2. No more tha 5 tractors or motor vehicles (combined total) are <br /> permitted t• be stored or parked outside overnight. <br /> 3. Construct'on of any structure to be located on the property requires <br /> approval •f the Town Board. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as he owners of the land. Failure to record the restrictions <br /> will cause the r zone to be null and void. <br /> CONDITION <br /> This amendmen' will become effective upon a change of zoning from C-2 <br /> Commercial ( ' Aendment #3206) to R-3 Residential on the existing shop property, <br /> Parcel #0807 102-8600. Failure to rezone the 'existing shop property to <br /> residential -hall null and void this amendment. _. - <br /> CERTIFIED • 'VEY REQUIRED <br /> The owner or owners of the land shall within 90 days of approval of this <br /> rezone by Dane County prepare a certified survey map that describes the land <br /> to be rezoned. Said survey shall be submitted to Dane County for approval and <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record , e survey will cause the rezone to be null and void. <br /> EFFECTIVE DATE: <br />
