If the deed restriction recorded is other than as was <br /> specified by the ordinance amendment, the rezone is null and void. <br /> I have enclosed a copy of the ordinance amendment approved by the <br /> county. <br /> Also, site approval for a residence for an owner of 35, or more, <br /> acres is not currently available, this was null & voided by the <br /> circuit court decision on Ordinance #36. Ordinance #13 , intended <br /> to reinstate the site approval, has not yet been approved by the <br /> county. Therefore, an owner will have to either verify 30% of <br /> gross income derived from production on the land, or rezone an area <br /> for the residence. <br /> If you have any questions please contact me. <br />
