The Agriculture, Environment & Zoning Committee of the Dane County Board, pursuant to its powers and after a public <br /> hearing, the applicant for Conditional Use Permit No. 30/ or his agent being afforded and opportunity to pre- <br /> sent relevant facts supporting the application, and after hearing all persons opposing such application, does here- <br /> by make the following: <br /> FINDING OF FACT <br /> 1. That the establishment, maintenance, and operation of the proposed conditional use will not be detrimental to or en- <br /> danger the public health, safety, morals, comfort or general welfare. <br /> 2. That the uses, values and enjoyment of other property in the neighborhood for purposes already permitted will not be <br /> substantially impaired or diminished by the establishment, maintenance and operation of the proposed conditional use. <br /> 3. That the establishment of the proposed conditional use will not impede the normal and orderly development and im- <br /> provement of the surrounding property for uses permitted in the district. <br /> 4. That adequate utilities, access roads, drainage and other necessary site improvements will wst be made. <br /> 5. That adequate measures will amt be taken to provide ingress and egress so designed as to minimize traffic congestion <br /> in the public streets. <br /> 6. That the proposed conditional use does air conform to all applicable regulations of the district in which it is pro- <br /> posed to be located. <br /> Fnr Conditional Uses in the A-1 Agriculture (Exclusive) District, the Following Additional Findings Shall be Made: <br /> 1. This use will ari►benefit the needs of either the residents or the agricultural activities in the area. <br /> 2. There are not other locations available for this use. <br /> 3. The land to be occupied by this use is not productive agricultural land. <br /> 4. Public services needed by this use are a 4 available. <br /> 5. Public services'needed by this use AMR not be furnished without becoming an unreasonable burden on the taxpayers. <br /> 6. Viking Stone Co. & the Town Board shall evaluate and determine acceptable blasting <br /> charge weights and other blast design techiaues, such as delay and multiple row patterns <br /> which will provide the maximum practical relief. A seismograph shall be used during <br /> blasting to verify that blasting levels, etc. , agreed upon are being adhered to. 2) . Viking ' <br /> Stone Co. and the Town Board shall determine acceptable roads and truck routes. 3) . Viking <br /> Stone Co. representative/s and pertinent insurance agents shall inspect and verify the <br /> condition of existing homes within 1/2 mile, more or less. 4) . Viking Stone Co. shall <br /> assume responsibility for any damage to roads or buildings which is caused by the mineral <br /> extraction operation. 5) . The mineral extraction permit shall be for four years. <br /> 1 <br />
