Revised plans for shoreline stabilization are needed to address <br /> incorporation or removal of concrete foundation after removal of <br /> non-complying deck\platform. <br /> CONCLUSION: <br /> 1. The project as planned, with specified conditions; will not <br /> result in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and <br /> healthful conditions. Motion carried - 4-0. <br /> #2550. Appeal by Thomas R. Klein for a variance from required <br /> setback from normal high watermark as provided by Section 11. 03 (2) <br /> to permit proposed accessory building at 1750 CTH BB in the NE 1/4 <br /> NW 1/4 - Section 13 , Town of Cottage Grove. <br /> IN FAVOR: Thomas R. Klein OPPOSED: --- COMMUNICATION: Dane <br /> County Highway Department <br /> GASKILL\DREPS to grant, with condition, variance of 61 feet to <br /> normal highwater mark to permit proposed 36 ' x 63 ' storage <br /> building. <br /> CONDITION: <br /> 1. Install 100 feet of erosion control fencing (filter fabric <br /> fence) between proposed building location and agricultural drainage <br /> ditch prior to site disturbances. (Fence shall extend 20± feet <br /> beyond each end of proposed building) . <br /> FINDING OF FACT: <br /> 1. Proposed building would be located on the only portion of this <br /> parcel not either designated as wetlands, or covered by mature <br /> trees, or used for house, yard, driveway and septic system, or <br /> inaccessible due to wetlands. <br /> 2 . Waterway is shown as a navigable stream on official maps, yet <br /> is, in fact, a dredged agricultural drainage ditch. <br /> 3 . Erosion control measures will serve to protect the stream. <br /> Applicant will be given erosion control specifications when zoning <br /> permit is issued. <br /> CONCLUSION: <br /> 1. Variance is not contrary to rights of others to the public <br /> interest. <br /> 2 . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. Motion carried - 4-0. <br /> #2552 . Appeal by Harmon and Nell Ray for a variance from required <br /> sideyard as provided by Section 10. 07 (7) to permit proposed <br /> addition to existing single family residence at 3054 Shadyside <br /> Drive being Lot #2 and part Lot 3 , Shadyside Park - Section 30, <br /> Town of Pleasant Springs. <br /> IN FAVOR: Harmon and Nell Ray, E.
