Install 100 feet of erosion control fencing (filter fabric <br /> fence) between proposed building location and agricultural drainage <br /> ditch prior to site disturbances. (Fence shall extend 20± feet <br /> beyond each end of proposed building) . <br /> FINDING OF FACT: <br /> 1. Proposed building would be located on the only portion of this <br /> parcel not either designated as wetlands, or covered by mature <br /> trees, or used for house, yard, driveway and septic system, or <br /> inaccessible due to wetlands. <br /> 2 . Waterway is shown as a navigable stream on official maps, yet <br /> is, in fact, a dredged agricultural drainage ditch. <br /> 3 . Erosion control measures will serve to protect the stream. <br /> Applicant will be given erosion control specifications when zoning <br /> permit is issued. <br /> CONCLUSION: <br /> 1. Variance is not contrary to rights of others to the public <br /> interest. <br /> 2 . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant.
