BOA MINUTES 8/25/94 <br /> PAGE 6 <br /> FINDING OF FACT: <br /> 1. Garage with access onto West Badger Road would require 30 foot <br /> setback to Fiedler Lane right-of-way. Garage with access onto <br /> Fiedler Lane would require 20 foot setback to Fiedler Lane right- <br /> of-way Dane County Code of Ordinances Section 10. 16 (6) (b) 4. <br /> 2. Access onto Fiedler Lane would minimize variance, reduce hazard <br /> of entry onto busier W. Badger Road, and reduce obstruction of <br /> vision triangle caused by cars parking in driveway accessing West <br /> Badger Road. <br /> 3 . Twenty foot is minimum standard garage depth. <br /> CONCLUSION: <br /> 1. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2 . Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried - 4-0. <br /> #2545. Cheney, P.E. <br /> KLOPP\DREPS to grant, with conditions, permit to fill and grade to <br /> permit driveway construction and control erosion associated with <br /> construction of new single family residence. <br /> CONDITIONS:_ <br /> 1. That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with the <br /> Zoning Department before commencement of any work. <br /> 2 . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules and <br /> regulations particularly Section 11. 05 (4) of Dane County Code of <br /> Ordinance. <br /> 3 . That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 4 . Deadline of October 15, 1994 for seeding disturbed areas or, if <br /> not seeded by 10\15\94, confer with Zoning Department to determine <br /> how to stabilize site through winter; <br /> 5. Install filter fabric fence around disturbed area between house <br /> and creek. <br /> FINDING OF FACT: <br /> 1. Special Exception Permit application is for filling and grading <br /> of driveway to access new pole barn and house under construction. <br /> 2 . Excavation for new house and backfill within normal limits of <br /> construction are excempt from Special Exception Permit. <br /> 3 . There are some stripped areas and piles of excavated materials <br /> around house under construction, as shown in pictures taken during <br /> current week by Mrs. Kerl. <br /> 4 . Area of driveway near stream is flat; stream is bordered by <br /> heavy grass cover which will effectively slow run-off. <br />
