BOA 6/23/94 Minutes <br /> Page 11 <br /> #2478. Vermont Lutheran Church - Vermont - 1/27/94 P.H. <br /> KLOPP\DREPS to reconsider and grant amendment to variance from <br /> required setback road to allow addition to existing church to be <br /> constructed 10 feet from right-of-way of Vermont Church Road. <br /> FINDING OF FACT: <br /> 1) . Previously approved variance was based upon mathematical <br /> error. <br />{ 2) . Conditions of approval, dated 4/28/94, remain in effect. <br /> 3) . Township is relocating right-of-way away from church. <br /> 4) . Addition is needed to accommodate handi-capped entrance. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> Motion carried - 4-0. <br /> #2445 Neitzel - Dunn 1/27/94 P.H. <br /> IN FAVOR: B. Kaufmann & T. Neitzel OPPOSED: --- COMMUNICATION: --- <br />' Dreps/Gaskill to grant, with conditions, variance of 32 feet, plus <br /> or minus, from required setback to normal high water mark to allow <br /> residence addition as proposed. <br /> CONDITIONS: <br /> 1. That lakeside deck, constructed without permit, be either <br /> removed or brought into compliance. <br /> 2 . Hot tub, located on deck be removed. <br /> 3 . Items 1 and 2 be resolved within 60 days. <br /> FINDING OF FACT: <br /> 1. Addition to residence is within required setback to normal high <br /> water mark, however is to be located landward side of existing <br /> residence. <br /> 2 . Several variances already granted for this property. <br /> 3 . Addition is for living space for growing family. <br /> 4 . Adjoining properties setback considerably farther from normal <br /> high water mark. <br /> CONCLUSION: <br /> 1. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2 .
