kr, BOARD OF ADJUSTMENT <br /> MINUTES <br /> MEETING OF MARCH 24, 1994 <br /> PRESENT: Dreps, Quackenbush, Gaskill and Klopp <br /> ALSO: Reynolds. <br /> Meeting called to order at 6:33 P.M. by Chairman Quackenbush in <br /> Room #2E City-County Building to hold Public Hearing as published <br /> by Class II Notice. <br /> MINUTES: DREPS/GASRILL to amend minutes of February 24, 1994 <br /> Hearing RE: Vote total of #2468 to read: "Motion carried - 3-1" <br /> DREPS/GASRILL to approve minutes of March 17, 1994 and minutes of <br /> February 24, 1994 as amended. Motion carried - 3-0. <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2485 - Divall - Westport - 2/24/94 P.H. <br /> DREPS/GASRILL to grant, with conditions, permit to fill and grade <br /> within 300 feet of Six Mile Creek for the purpose of public utility <br /> installation, as proposed. <br /> CONDITIONS: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with the <br /> Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules and <br /> regulations particularly Section 11. 05 (4) of Dane County Code of <br /> Ordinances. <br /> 3) . That there be filed with the Zoning Department a certificate <br /> of compliance by a licensed engineer at the completion of the <br /> project. <br /> 4) . Project completion and certification deadline July 1, 1994 . <br /> FINDING OF FACT: <br /> 1) . Project is intended to cross Six Mile Creek with public sewer <br /> line. <br /> 2) . Majority of earth disturbing activities amount to trenching <br /> for sewer line and cover-up. <br /> 3) . Engineering provided by Mid-States and Associates. <br /> 4) . Approvals from township, Department of Natural Resources, Army <br /> Corps and sanitary district are in file. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will not <br /> result in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and <br /> healthful conditions.
