MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> tW <br /> COMMITTEE HELD ON December 19, 1991 <br /> The following members were present: Edgar, Rendall, Clark-Gaskill, Harvey and <br /> Quackenbush. <br /> Also: Fleck and Reynolds. <br /> Meeting called to order at 6:30 P.M. by Chairman Harvey in Room 2E City-County <br /> Building to hold public hearing as published by Class II Notice. <br /> Edgar/Quackenbush to approve minutes of November 21 and December 17, 1991. <br /> Motion carried - 5-0. <br /> #2160. - Sayers - Dunn - 8/22/91 P.H. <br /> No appearance. <br /> Quackenbush/Clark-Gaskill to extend project completion deadline until May 1, <br /> 1992 as per requested by applicant. Motion carried - 5-0. <br /> #2195. Whalin - Pleasant Springs - 10/24/91 P.H. <br /> Appearance: B. Wolfe <br /> Quackenbush/Edgar to extend project completion deadline until June 1, 1992 as <br /> per requested by applicant. Motion carried - 5-0. <br /> (Board directs Staff to inspect, as soon as possible, property for erosion <br /> prevention measures). <br /> (11, #2188. Cutrell - Westport - 11/21/91 P.H. <br /> Appe�arance: J. Cutrell <br /> R�Pidall/Quackenbush to grant variance of 13.5 more or less feet from required <br /> average setback to normal high watermark to permit sunroom and deck addition <br /> to existing residence as constructed. <br /> FINDING OF FACT: <br /> 1).•r Structures were built under permit obtained using inaccurate data. <br /> f 2): Deck addition replaces former structure in need of repair. <br /> 3). Residential additions as constructed are not as near to normal high <br /> watermark as is garage on same lot. <br /> 4). This lot has Special Exception Permit granted 11/21/91 to fill/grade as <br /> exists and proposed. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 5-0. -. - <br /> #2191. Olson - Westport - 10/24/91 P.H. <br /> Appearances: R. Keuhling, J. Cutrell, L. Lehman, T. Speerscheider, D. <br /> Simonsen, M. Simonsen, M. Gerhardt, S. Gerhardt, J. Olson, D. Olson. <br /> Edgar/Rendall to grant with condition Variance of 43 more or less feet from <br /> required setback to normal high watermark to allow construction of single <br /> family residence, within 7 more or less feet of right side sideyard. <br /> CONDITION: 1). As per Mark Gerhardt survey plan dated December 9, 1991 <br /> location is approved. <br /> FINDING OF FACT: <br /> 1). Setback variance is needed not from main channel but rather from low <br /> lying area actually to sideyard. <br /> 2). Without variance/variances lot is virtually unbuildable. <br /> 3). Normal high water mark is very inconsistant in immediate area due to past <br /> filling and excavations. <br />
