Appeal by Butch Sparby, agent for George Colletti for a Special <br /> Exception Permit as provided by Sections 11.05(3) and 11.04(2) to permit <br /> filling, grading, shoreline clear cutting, etc. , within 300 feet of Lake <br /> Mendota at 5878 Cedar Wood Court being Lot #20, Assessor's Plat of Fox Bluff - <br /> Section 5 So. , Town of Westport. <br /> IN FAVOR: B. Sparby OPPOSED: --- COMMUNICATION: Town Board, County <br /> Highway. <br /> Quackenbush/Rendall to grant permit with conditions, to fill/grade as per <br /> Jeffrey Melville engineered plan. <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4)of Dane County Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 4). Permit valid for 60 days from issuance. <br /> FINDING OF FACT: <br /> 1). Project commenced without required Special Exception Permit. <br /> 2). Terracing of steep slope should stabilize area with tendency for eroding. <br /> 3). Disturbed area will be revegitated to further retard erosion. <br /> CONCLUSIONS: <br /> I (00 1). The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 5-0. <br /> Petitions from previous hearings: <br /> #2161. Weber - Dunn - P.H. 8/22/91. <br /> Appearance: J. Weber <br /> Quackenbush/Clark-Gaskill to grant, with conditional permit to fill/grade as <br /> per amended request by applicant. <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2).
