Appeal by Bower's Construction, agent for John Schkirkie for a
variance from required setback from road as provided by Section 10.17(5) to
permit residence as constructed at 2431 Char Court being Lot #14, 1st Addition
to Olsonia Plat - Section 14, Town of Dunn.
Rendall/Clark-Gaskill to hold in abeyance until January Hearing to alow
applicant to seek other avenues of resolution. Appeal by Robert Vejvoda for a variance from required setback from
road as provided by Section 10.17(3)(b) to permit addition to existing
residence at 2100 Barber Drive in the NE 1/4 NW 1/4 - Section 26, Town of Dunn.
Appearances: M. Cassidy.
Quackenbush/Clark-Gaskill to deny requested variance 2-3. (Rendall, Edgar,
Harvey - no). Motion failed.
Edgar/Rendall to grant variance of 30 feet from required setback to
right-of-way or 63 feet whichever is greater from centerline to Barber Drive
to permit structural alteration (roof) over existing residence.
FINDING OF FACT:
1). Applicant wishes roof consolidation over existing residence - presently
several additions cause converging roof lines.
2). Existing roofs are in need of repair with owners suffering water damage.
3). A single truss roof system will create a minimal englargement of living
area of non-conforming residence.
4). Residence is further restricted by highway expansion which resulted in
additional setback requirement.
CONCLUSION:
1). Variance preserves the zoning ordinance as much as possible without
injustice to applicant.
2). Variance is necessary to provide right enjoyed by others.
Motion carried. 3-2 (Quackenbush/Clark-Gaskill- no).
#2177. Appeal by D. W. Nelson Inc. , agent for Henry Sabien for a variance
from required maximum height of boathouse as provided by Sections 10.07(2) and
11.03(3) to permit boathouse as constructed at 2025 Skyline Drive being Lot
#8, Kegonsa Grove - Section 29, Town of Pleasant Springs.
Appearances: D.
