Motion <br /> carried - 4-1 . <br /> APPEALS FROM PREVIOUS HEARINGS`< <br /> #2421. Johnson - Pleasant Springs - 7/22/93 Public Hearing. <br /> APPEARANCE: K. Johnson, L. Quale <br /> Gaskill/Dreps to hold requested permit in abeyance until October <br /> Hearing pending submittal of endorsed plan with winter contingency <br /> submittal. Motion carried - 4-0. <br /> #2430. Keene - Westport - 7/22/93 <br /> (Combined with Appeal #2449 later on agenda) . <br /> September 23 , 1993 Public Hearing: <br /> #2433 . Appeal by Kenneth and Robert Ostrander for a variance - <br /> from required setback from road as provided by Section <br /> 10. 17 (5) to permit reconstruction of existing residence <br /> at 2477 Waubesa Hill Road being Lot #34, First Addition <br /> to Waubesa Heights - Section 16, Town of Dunn. <br /> IN FAVOR: K & R Ostrander OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> DREPS/GASKILL to grant variance of 0. 8 feet from required setback <br /> to right-of-way of Waubesa Hill Road to permit rebuild of existing <br /> residence as constructed. <br /> FINDING OF FACT: <br /> 1) . Residence re-constructed after 1991 tornado damage over <br /> existing foundation. <br /> 2) . Original residence constructed in late 1960 ' s which pre-dated <br /> Zoning Department inspection. <br /> 3) . Similar situation, with variance granted, at previous hearing <br /> (Variance #2296 - 8/27/92 Hearing) . <br /> CONCLUSION: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> flow interest. <br /> Motion carried - 4-0. <br />
