MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON August 26, 1993 <br /> The following members were present: Quackenbush, Gaskill, Klopp, <br /> Lynch and Dreps. <br /> Also: Fleck and Reynolds. <br /> Meeting called to order at 6: 30 P.M. Chairman Quackenbush in Room <br /> #2E - City-County Building to hold public hearing as published by <br /> Class II notice. <br /> Dreps/Gaskill to approve minutes of July 22 and August 24, 1993 . <br /> Motion carried - 5-0. <br /> APPEALS PROM PREVIOUS HEARINGS: <br /> #203 . Becker - Pleasant Springs - 12/15/72 P.H. <br /> Appearance: Mary Hanson <br /> Dreps/Gaskill to grant variance of 1. 1 feet (or 14 inches) from <br /> required left sideyard to permit single family residence as <br /> constructed. <br /> FINDING OF FACT: <br /> 1) . Request is for amendment/modification of previous variance <br /> approval. <br /> 2) . December 12 , 1972 Variance #203 granted to allow 9 . 5 feet <br /> (110. sideyard (left side) while actual construction is at closest point <br /> 8 . 4 feet from (left side) sideyard. <br /> 3) . Structure has been constructed and occupied by applicant for <br /> 20+ years. <br /> 4) . At the time of construction Zoning Department made no on-site <br /> inspections. <br /> 5) . As in previous similar approvals, "staleness" of sideyard <br /> encroachment applys. <br /> 6) . Property is in an area of numerous non-conforming structures <br /> and numerous variances granted. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. Motion carried - 5-0. <br /> #2365. Mason - Dunn - 3/25/93 P.H. <br /> GASKILL/LYNCH to grant, with condition, completion and <br /> certification deadline extension, for approved Special Exception <br /> Permit, until October 1, 1993 , due to unseasonable wet weather. <br /> CONDITION: <br /> 1) . If project not completed this Fall that erosion control <br /> measures remain in place and Winter stabilization measures be in <br /> place. <br /> Motion carried - 5-0. <br /> #2405.
