ZNR 7/22/93 Minutes <br /> tow Page 4 <br /> FINDING OF FACT: <br /> I ). Request has been previously approved on 2 occassions (Variances #1790 and <br /> 2122) to which permission has expired. <br /> 2). Property is bounded by roads on 3 of 4 sides. <br /> 3). Highway has expanded right-of-way and the likely hood of further highway <br /> expansion is doubtful . <br /> 4). Addition will consist of 2 additional warehouse units. <br /> CONCLUSION: <br /> I ). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 5-0. <br /> #2414. Appeal by Michael & Eileen Schey for a variance from required setback <br /> from road as provided by Section 10.17(3) to permit additions to existing <br /> residence as constructed at 1984 Branch Road in the SE 1/4 SW 1/4 - Section <br /> 23, Town of Bristol . <br /> IN FAVOR: E & M Schey OPPOSED: --- COMMUNICATION: --- <br /> Gaskill/Dreps to grant variance 20.3 feet from required setback to <br /> right-of-way of Branch Road to permit entry deck and porch addition as <br /> constructed. <br /> FINDING OF FACT: <br /> I ). Approximately 1/3 of existing residence is already within required <br /> setback from road. <br /> 2). Front entry/deck extends only slightly nearer to right-of-way than does <br /> corner of existing dwelling. <br /> 3). Residence as situated is over 100 years old. <br /> 4) . Property is on a dead-end street. <br /> CONCLUSION: <br /> I ). Variance is not contrary to rights of others or to the public interest. <br /> 2) . Smith OPPOSED: --- COMMUNICATION: Town Board, <br /> Environmental Health Department and neighbor (Pertzborn) letter. <br /> Gaskill/Klopp to grant a variance of 7.85 feet from required total sideyards <br /> of 25 feet to allow proposed residential addition to be 7.25 feet from <br /> required right sideyard. <br /> FINDING OF FACT: <br /> I ). Property is zoned R-1 which has combined sideyard required of 25 feet and <br /> minimum of 10 feet one side. <br /> 2). Lot is irregular shaped and narrows to rear. <br /> 3). Proposed addition (20' x 20' ) extends existing building line. <br /> 4). Neighbor, who is unwilling to adjust lot line, is in favor of variance. <br />
