BOA MINUTES 11/4I/9b <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES NOVEMBER 21, 1996 <br /> PRESENT: Gaskill, Quackenbush, Klopp, Kay and Sayles. <br /> ALSO: Reynolds . <br /> Meeting called to order at 6: 30 P.M. in Room 2-G City-County <br /> Building by Chair Quackenbush to hold Public Hearing as <br /> published by Class II Notice. <br /> Minutes: GASKILL/SAYLES to approve minutes of October 17 <br /> and October 24, 1996 as submitted. Motion carried - 4-0. <br /> Klopp, Abstain. <br /> #2781 . Appeal by Michael Roach for a variance from required <br /> rearyard as provided by Section 10 . 07 (8) to permit addition <br /> to existing residence at 136 Beach Avenue being Lots 13 and <br /> 14, Block #3, Highwood Estates 1st Addition - Section 36, <br /> Town of Albion. <br /> IN FAVOR: M. Roach OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> KAY/SAYLES grant variance of 17 feet from required rearyard <br /> setback to permit basement addition under existing residence <br /> as proposed. <br /> FINDING OF FACT: <br /> 1) . Applicant has residence built, in the 1930' s, on post <br /> foundation which has become structurally in need of repair. <br /> 2) . Plan is to raise residence and pour full basement under <br /> existing footprint. <br /> 3) . Town of Albion Building Inspector, Al Switala and <br /> applicant attest to structure being sound justifying <br /> addition versus demolition and constructing anew. <br /> 4) . Property is in an area of numerous non-conforming <br /> structures with numerous variances being granted. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance asmuch as <br /> possible without injustice to applicant . <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. Motion carried - 4-0 . Quackenbush, <br /> abstain. <br /> C <br />
