(10, <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF JANUARY 25, 1996 <br /> PRESENT: Quackenbush, Gaskill, Klopp and Sayles. <br /> ALSO: Reynolds . <br /> Meeting called to order by Chair Quackenbush at 6: 30 P.M. in <br /> Room 2-E City-County Building to hold Public Hearing as <br /> published by Class II Notice. <br /> MINUTES: GASKILL/SAYLES to amend minutes of 12/28/95, Appeal <br /> #2691, finding of fact #4, to read: 4) . Structure, as <br /> proposed, may further reduce insufficient parking within <br /> complex. Motion carried 4-0. <br /> GASKILL/SAYLES to approve minutes of 12/21 and 12/28 as <br /> amended. Motion carried - 4-0. <br /> #2700. Appeal by Bill Vest for a variance from required <br /> setback from normal high watermark as provided by Section <br /> 11 . 03 (2) to permit decks and stairs as constructed at 851 <br /> CTH N in the SW 1/4 SW 1/4 Section 16, Town of Dunkirk. <br /> IN FAVOR: B. Vest OPPOSED: --- COMMUNICATION: <br /> Department of Natural Resources, County Highway, Town Board <br /> SAYLES/GASKILL to grant, with condition, variance of 29± <br /> feet from required setback to normal high watermark of <br /> Yahara River to permit decks/walkways as constructed. <br /> CONDITION: <br /> 1) . That there be no further structure encroachment towards <br /> river. <br /> Finding of fact: <br /> 1) . Applicant has constructed multi-tiered deck/walkway in <br /> conjunction with retaining walls permitted under Special <br /> Exception Permit #2676. <br /> 2) . Retaining walls and walkways stabilize banking after <br /> refuse removed from former farm homestead dump site. <br /> 3) . Department of Natural Resources repaired downstream dam <br /> and formed a lake district. <br /> 4) . Meandering river bed previously 100-150 feet from <br /> structure as constructed. <br /> C <br />
