4 BOA 9/28/95 #2671 . Appeal by Myron Pozniak & Kathleen Baus for a variance from required setback from Normal High Water Mark as provided by Sec. 11 . 03 . (2) to permit addition to existing residence at 5561 Kupfer Rd. being Lot 1 CSM 5322 in the SE1/4 NE1/4, Section 28, Town of Westport. IN FAVOR: M. Pozniak, A. Kay OPPOSED: --- COMMUNICATION: DNR, Town Board. Gaskill/Sayles to deny request variance from required setback to normal high watermark to permit proposed screen porch and deck as constructed. FINDING OF FACT: 1) . Residence constructed in 1988 with plan showing no raised deck. 2) . Applicant proposes to convert portion of existing deck to screen porch. 3) . Only small corner of deck actually encroaches . CONCLUSION: 1) . Unnecessary hardship was not proven. Motion carried - 5-0 . (010 #2672 . Appeal by Paul Kleinsmith and Thomas Franke for a variance from required setback from Normal High Water Mark and sideyard as provided by Sec. 11 . 03 (2) & 10 . 16 ( 6) to permit deck, boathouse and fence as constructed at 3171 & 3173 Sunnyside St. in the the NE1/4 SE1/4, Section 13, Town of Dunn. IN FAVOR: P & T Kleinsmith OPPOSED: --- COMMUNICATION: DNR, Town Board. DREPS/SAYLES to grant, with condition, variance of 4 feet from required left sideyard to permit boathouse accessory structure to remain essentially as located. CONDITIONS: 1) . That 8' x 10' boathouse be removed the event of larger boathouse construction. DREPS/GASKILL to deny setback from normal high watermark to permit deck encroachment as constructed. Motion carried 5- 0 . SAYLES/DREPS to deny setback from normal high watermark to permit fence as constructed. 4-1 (Klopp, no) . FINDING OF FACT: 1) . Boathouse shed presently encroaches on adjoining property 1 foot and will be relocated entirely on applicants property. Cow 2) . Deck and fence both constructed by previous owner.
