BOA MINUTES 10/24/02 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF October 24, 2002 <br /> PRESENT: Sayles, Kay, Ross and Long, <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. by Chairman Ross in Room 2-F to hold Public <br /> Hearing as published by Class II Notice. <br /> MINUTES Sayles /Kay to approve minutes of 9/12 and 9/19/02 as submitted. <br /> (Kay emphasized that in light of recent inquiries that minutes of #3207 are accurate as <br /> submitted). <br /> Motion carried 3-0. (Long - Absent). <br /> OCTOBER PUBLIC HEARING ITEMS: <br /> #3209. Appeal by Cynthia Culham and Timothy Gartzke for variances from required <br /> setback from road, sideyard, and minimum lot width and area as provided by Sections <br /> 10.17(5), 10.07(7) and 11.03(1) and 10.05(4) to permit proposed addition to existing <br /> residence at 3166 Shadyside Drive being Lot#16, Vea Park and additional lands in the <br /> SW 1/4 SW 1/4 Section 30, Town of Pleasant Springs. <br /> IN FAVOR: B. Sweeney OPPOSED: -- COMMUNICATION: Town <br /> Board <br /> Kay/ Sayles to grant a variance of 34.65 feet from minimum required lot width of lots <br /> in the shoreland district to permit lands to be added to existing lot and to grant a variance <br /> of 18 feet from minimum required setback from road to permit garage construction as <br /> part of proposed residential addition. Motion carried 4 - 0. <br /> Sayles/ Kay to grant variance,with condition, of 5 feet from required left sideyard to <br /> permit residential addition as proposed. <br /> CONDITION: That applicant record a restrictive covenant, running in favor of Dane <br /> County, that ties the two lots together for zoning purposes prior to obtaining a Zoning <br /> permit if intending to start project prior to rezone process being completed. <br /> Finding of fact: <br /> 1). Applicant proposes substantial additions to existing single family residence, to <br /> include 2 story living space and attached garage. <br /> 2). Residence presently located on Lot#16, Vea Park and application proposes to add <br /> 990 square feet by Certified Survey Map. <br /> 3). 10.07(7) Dane County Code of Ordinances requires a minimum sideyard of 10 feet to <br /> which a variance from sideyard, if granted, would become unneeded when Certified <br /> Survey Map is recorded. <br /> 4). Setback from road is a technical variance as property has no public road frontage. <br />
