BOA MINUTES 9/19/02
PAGE 1
BOARD OF ADJUSTMENT
MINUTES OF September 19, 2002
PRESENT: Long, Sayles, Klopp, Kay and Ross
ALSO: Reynolds
Meeting called to order at 6:30 P.M. by Chair Ross in Room 2-F City-County Building to
hold Public Hearing as published by Class II Notice.
MINUTES: Klopp/Sayles to approve minutes of 8/15/02 and 8/22/02 as submitted.
Motion carried 5-0.
SEPTEMBER PUBLIC HEARING ITEMS:
#3200. Appeal by Steve and Joyce Clawson for variances from required setback from
road and lot width and area as provided by Sections 10.17(3), 11.03(1) and 10.05(4) to
permit reconfiguration of existing lots by Certified Survey Map at 6896 Canal St., and at
and North of 1394 Range Trail being Lots 3, 4, 5 and 6, Block 6, Plat of Paoli, Section 3,
Town of Montrose.
FAVOR: S. Clawson OPPOSED: ---- COMMUNICATION:
KAY/KLOPP to grant variances of 29.3 feet from right-of-way of Range Trail and 11.6
feet from right-of-way of Canal Street to permit residence at 6896 Canal Street to remain
after lot division. Also, to grant variances of 12 feet from minimum required lot width
and 8,384 square feet to allow reconfiguration of 4 platted lots into 3 CSM lots as
proposed.
Finding of fact:
1). Applicant owns 4 contiguous lots in unincorporated Village of Paoli and wishes to
reconfigure into 3 lots by CSM.
2). Applicant started construction of a garage which along with residence exceed
maximum lot coverage.
3). Original lots as platted, in 1846, were 66' wide by 132' deep.
4). Section 10.07(40(a) R-3 residential District Dane County Code of Ordinances
requires a minimum lot area of 20,000 square foot and minimum lot width of 100 feet.
5). The proposed vacant lot is intended to be utilized as a building site for child of
owner.
Conclusion:
1). Variance preserves the zoning ordinance as much as possible without injustice to
applicant.
2). Variance is not contrary to rights of others or to the public interest.
Motion carried 4-0. (Sayles, abstain).
