BOA MINUTES 9/19/02 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF September 19, 2002 <br /> PRESENT: Long, Sayles, Klopp, Kay and Ross <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. by Chair Ross in Room 2-F City-County Building to <br /> hold Public Hearing as published by Class II Notice. <br /> MINUTES: Klopp/Sayles to approve minutes of 8/15/02 and 8/22/02 as submitted. <br /> Motion carried 5-0. <br /> SEPTEMBER PUBLIC HEARING ITEMS: <br /> #3200. Appeal by Steve and Joyce Clawson for variances from required setback from <br /> road and lot width and area as provided by Sections 10.17(3), 11.03(1) and 10.05(4) to <br /> permit reconfiguration of existing lots by Certified Survey Map at 6896 Canal St., and at <br /> and North of 1394 Range Trail being Lots 3, 4, 5 and 6, Block 6, Plat of Paoli, Section 3, <br /> Town of Montrose. <br /> FAVOR: S. Clawson OPPOSED: ---- COMMUNICATION: <br /> KAY/KLOPP to grant variances of 29.3 feet from right-of-way of Range Trail and 11.6 <br /> feet from right-of-way of Canal Street to permit residence at 6896 Canal Street to remain <br /> after lot division. Also, to grant variances of 12 feet from minimum required lot width <br /> and 8,384 square feet to allow reconfiguration of 4 platted lots into 3 CSM lots as <br /> proposed. <br /> Finding of fact: <br /> 1). Applicant owns 4 contiguous lots in unincorporated Village of Paoli and wishes to <br /> reconfigure into 3 lots by CSM. <br /> 2). Applicant started construction of a garage which along with residence exceed <br /> maximum lot coverage. <br /> 3). Original lots as platted, in 1846, were 66' wide by 132' deep. <br /> 4). Section 10.07(40(a) R-3 residential District Dane County Code of Ordinances <br /> requires a minimum lot area of 20,000 square foot and minimum lot width of 100 feet. <br /> 5). The proposed vacant lot is intended to be utilized as a building site for child of <br /> owner. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried 4-0. (Sayles, abstain). <br />
