Brokaske—8/22/02 P.H. <br /> ROSS/LONG to uphold the decision of the Dane County Zoning Administrator as it <br /> pertains to substantial farm income review as provided by Sections 10.04, 10.123(1) and <br /> (2) and 10.25(2) Dane County Code of Ordinances. <br /> Finding of fact: <br /> 1). Applicant contested the Zoning Administrator's denial of a zoning permit based upon <br /> density limits, described in the Dane County Farmland Preservation Plan for the Town of <br /> Montrose, for this property being exceeded. <br /> 2). Staff comment by Brian Standing, Senior Planner, Dane County Planning & <br /> Development Department concurs density limits being exceeded. <br /> 3). The applicant has a pending law suite against the Town of Montrose and the Town <br /> has chosen not to respond regarding this appeal. <br /> 4). The Board, in a previous appeal, had directed the Zoning Administator to bring the <br /> County requirements for residence siting more into consistancy with requirements of <br /> Chapter 91 WI Statutes - (Appeal#3140—Town of Perry—Gehl— 8/23/01). <br /> 5). Similar appeal of the Board of Adjustment Ruling was upheld by the Circuit Court. <br /> (01 CV—2487). <br /> Motion carried 4-0 (Sayles, abstain). <br /> SAYLES/KAY to adjourn.
