BOA MINUTES 6/27/02 <br /> PAGE 1 <br /> tiy BOARD OF ADJUSTMENT <br /> MINUTES OF 6/27/02 <br /> PRESENT: Sayles,Long,Ross, Kay, and Klopp <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. in Rm. 2-F City-County Building,by Chair Ross to <br /> hold Public Hearing as published by Class II Notice. <br /> MINUTES: .Sayles /Long to approve minutes of 5/16 and 5/23/02 as submitted. <br /> Motion carried 5-0. <br /> JUNE PUBLIC HEARING ITEMS: <br /> #3188. Appeal by Robert&Karen Vick for a variance from required lot area and width <br /> as provided by Section 10.07(4), 10.05(4) & 11.03(1) to permit residential use on <br /> property located Northwest of 3094 Sunnyside St. being Lot#1, Block#3, Monson's <br /> Park—Section 18, Town of Pleasant Springs. <br /> IN FAVOR: K. Rusalie OPPOSED: <br /> COMMUNICATION: ---- <br /> Sayles/Kay to grant variance of 50.8 feet from required lot width also to grant variance <br /> of 8551 square feet from required minimum lot area to permit rezone of existing platted <br /> lot. <br /> Finding of fact: <br /> 1). Lot is a pre-existing, substandard parcel in a plat of similarly sized lots. <br /> 2). Property is presently zoned RE-1, Recreational and has pending Application(#8417 <br /> 4/23/02 P.H.)to rezone to R-3 Residential. <br /> 3). Requested variances are to allow rezone to take place. <br /> 4). Property is a vacated lot with road frontage on 3 sides. <br /> 5). Applicant proposes no immediate uses and any construction would most likely <br /> require additional variances. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Proven case of unnecessary hardship. <br /> Motion carried: 5 - 0. <br /> #3189. Appeal by Allan Young for a variance from required sideyard and rearyard as <br /> provided by Sections 10.14(6) and(7) and 10.11(7)to permit redivision of existing lots <br /> by Certified Survey Map at 2901 Perry Street being Lots 3 and 4, McKenzie Commercial <br /> Plat—Section 35, Town of Madison. <br /> IN FAVOR: J.
