BOARD OF ADJUSTMENT MINUTES OF 5/23/2002 PRESENT: Sayles,Long,Ross, Kay, and Klopp ALSO: Reynolds Meeting called to order at 6:30 P.M. in Rm. 2-F City-County Building,by Chair Ross to hold Public Hearing as published by Class II Notice. MINUTES: KAY/SAYLES to approve minutes of April 18 and April 25, 2002 as submitted. Motion carried. 4-0 (Ross, abstain). #3186. Appeal by Kenneth Stuntebeck for a variance from required sideyard as provided by Sections 10.123(7) and 10.05(7)to permit accessory building as constructed at 6261 State Highway 73 in the SE 1/4 NW 1/4 Section 3, Town of Medina. IN FAVOR: K. Stuntebeck, L. Waddell OPPOSED: --- COMMUNICATION: Town Board SAYLES/KLOPP to postpone until June Hearing,pending submittal of requested materials. Motion carried. 5-0. thor #3187. Appeal by JoAnn Kittleson for variances from required setback from road and sideyard as provided by Sections 10.17(1) and 10.06(7)to permit new residence construction at 1131 State Highway 78 South being Outlot#9, Assessor's Plat of Daleyville, Section 8, Town of Perry. IN FAVOR: J. Kittleson, L. Price OPPOSED: --- COMMUNICATION: Town Board KAY/ to deny requested sideyard variance and to grant a variance of 26.5 feet of centerline. Motion failed for lack of a second. SAYLES/KLOPP to grant a variance of 21 feet from required setback to centerline of State Highway 78 also, to grant a variance of 5.5 feet from required sideyard to permit residence as proposed. Finding of fact: 1). Applicant proposes to replace existing mobile home with new residence in same location. 2). Buildable area limited by well on the North and septic system on the South. 3). Lot is irregular shaped and 75 ± feet deep and required setback from State Highway is 100 feet from centerline. 4). Without variances lot would be unbuildable. 5). Property is in an area of numerous non-conforming structures.
