IN Room 2-F City-County Building by Chair Ross <br /> to hold Public Hearing as published by Class II Notice. <br /> MINUTES: KLOPP/KAY to approve minutes of 2/14 and 2/21/02 as submitted. <br /> Motion carried. 4-0. (Sayles, abstain) <br /> MARCH PUBLIC HEARING ITEMS: <br /> #3178. Appeal by Randy Lansing for a variance from required sideyard, setback to <br /> normal highwater mark and repair/addition to a non-conforming structure as provided by <br /> Sections 10.07(7), 11.03(2) and 10.23 to permit addition/alteration of existing <br /> residence at 2811 Willow Court, Lot#15, Crescent Park—Section 9, Town of Dunn. <br /> IN FAVOR: R. Lansing OPPOSED: --- COMMUNICATION: Town Board <br /> KAY/SAYLES to deny a variance of 6 feet from normal high watermark to permit deck <br /> encroachment as proposed. Motion carried 5-0. <br /> KAY/KLOPP to deny a variance of 8.3 feet from left sideyard to permit second story <br /> addition atop existing residence as proposed. Motion carried 5-0. <br /> KAY/LONG to deny a variance from 10.23 Dane County Code of Ordinances to permit <br /> addition/alteration of existing non-conforming residence in excess of 50% of assessed <br /> value. Motion carried—5-0. <br /> Finding of fact: <br /> 1). Original building dates back to 1912 with a 39' x 32' bedroom addition in 1985 (ZP <br /> #37119). <br /> 2). Applicant proposed to tear down to foundation, that portion that has the sideyard <br /> encroachment and reconstruct 2 stories. <br /> 3). Applicant claims that portion to be razed is insufficient to construct atop. <br /> 4). Existing structure is 1.7 feet from right sideyard and 44 feet back from normal high <br /> watermark. <br /> 5). Proposed improvements exceed the maximum 50% allowed by 4300%±. <br /> Conclusion: <br /> 1). Unnecessary hardship was not proven. <br />
