Haack, H. Krantz OPPOSED: COMMUNICATION: <br /> County Highway <br /> KLOPP/SAYLES to grant, with condition, variance of 9.8 feet from required setback to <br /> right-of-way line of County Highway P to permit porch and handicap ramp as proposed. <br /> Condition: <br /> The structure shall be removed at the owners expense if future road improvement <br /> requires additional right-of-way. <br /> Finding of fact: <br /> 1). Residence built in 1948 and as constructed meets required 42 feet setback. <br /> 2). Applicant proposes 30' x 10' covered porch with wheelchair ramp to allow access to <br /> residence. <br /> 3). Location is designed to access driveway and avoids septic. <br /> 4). Property is in an area known as"Pine Bluff'with numerous nonconforming <br /> structures. <br /> Conclusion: <br /> 1). Variance preserves the Zoning Ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried—5-0. <br /> #3180. Appeal by Donald G. Foster for a variance from required setback from road as <br /> provided by Section 10.17(1) to permit residential addition as constructed at 6617 State <br /> Highway 73 in the SE 1/4 SE 1/4 Section 27, Town of York. <br /> IN FAVOR: D. Foster OPPOSED: --- COMMUNICATION: Town Board <br /> SAYLES/KAY to grant a variance of 7.67 feet from required setback to centerline State <br /> Highway 73 to permit residential addition as constructed. <br /> Finding of fact: <br /> 1). Applicant obtain a Zoning Permit which was issued in error(ZP 2000-464). <br /> 2). Addition is all to back side or away from right-of-way. <br /> 3). Existing 100 year old residence is entirely within required setback. <br /> 4). Minimum required setback per 10.17(1) Dane County Code of Ordinances are 42 feet <br /> from right-of-way or 100 feet from centerline whichever is greater. <br /> Cry <br />
