BOA 02/21/02 <br /> (11, PAGE 3 <br /> Finding of fact: <br /> 1). Applicant proposes to remove existing enclosed porch and re-construct utilizing same <br /> footprint, requiring a Variance of 10.1 feet from right-of-way of Dane Street. <br /> 2). Entry steps and porch are structurally unsafe. <br /> 3). Re-build will weatherize front of residence. <br /> 4). Property is in an area of numerous non-conforming structures. <br /> Conclusion: <br /> 1). Variance preserves the Zoning Ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried 4-0. <br /> #3177. Appeal by Thomas and Catherine Zdeblick for a variance from required <br /> maximum height of accessory building as provided by Section 10.05(3) to permit <br /> detached garage as constructed at 4517 Fox Bluff Lane being SW 1/2 Outlot#9, <br /> Assessor's Plat Of Fox Bluff Section 5 South, Town of Westport <br /> IN FAVOR: C. Dietzen OPPOSED: --- COMMUNICATION: Town Board <br /> Ross /Klopp to grant Variance of 1.9 foot from maximum height of accessory building <br /> to permit residential garage as constructed. <br /> Finding of fact: <br /> 1). Applicant was issued a zoning permit, in error for garage as constructed (ZP 1186- <br /> 2001). <br /> 2). Applicant was denied a variance of 3.9 feet from maximum accessory building height <br /> (#3156— 10/25/01). <br /> 3). Pitch and sidewall lowered (reduced average by 2 feet) and permit was issued. <br /> 4). Error in issuance due to interpretation of Section 10.01(8) and(10) and determining <br /> front of building. <br /> Conclusion: <br /> 1). Variance preserves the Zoning Ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried 4-0. <br /> OTHER BUSINESS AS PERMITTED BY LAW : <br /> Kay/Long to approve draft of letter to be sent to Town of Albion regarding the actions <br /> of its building inspector.
