BOA MINUTES 9/20/01 <br /> PAGE 1 <br /> tpr BOARD OF ADJUSTMENT MINUTES <br /> SEPTEMBER 20,2001 <br /> PRESENT: Sayles, Long,Ross, Klopp and Kay <br /> ALSO: Reynolds <br /> Meeting called to order at 6:32 P.M. by Chairperson Ross in Room 2-F City-County <br /> Building to hold Public Hearing as published by Class II Notice. <br /> MINUTES: SAYLES/KLOPP to amend minutes of 8/23/01 to read: MINUTES: <br /> ROSS/KAY to amend minutes of 126/01. <br /> Also to amend#3140 to read: LONG/KAY to direct Staff to request of the Zoning <br /> Administrator written clarification of his interpretation of owner/operator as found in <br /> 10.123(2)(b) specifically as it refer to usage of the backslash between owner and <br /> operator. <br /> SAYLES/KLOPP to approve minutes of 8/16/01 and minutes of 8/23/01 as amended. <br /> Motion carried 5-0. <br /> to, SEPTEMBER HEARING ITEMS: <br /> SAYLES/LONG to move#3154 to 1st item on agenda, as applicant has a flight to catch <br /> and requested early consideration. Motion carried- 5-0. <br /> #3154. Appeal by Kevin G. Wilson for a variance from required setback from road as <br /> provided by Section 10.17(4) to permit addition/alteration of existing residence at 4191 <br /> High Street being parts of Lots 1 and 2, Block#4, Greenridge Park, Section 9, Town of <br /> Dunn. <br /> IN FAVOR: K. Wilson, J. DeWalt OPPOSED: — COMMUNICATION: <br /> Town Board <br /> KAY/SAYLES to grant, with condition,variance of 11 feet from required setback from <br /> road to permit residential addition as proposed. <br /> Condition: <br /> 1). The addition shall be removed at the owner's expense if future road improvement <br /> requires additional right-of-way. <br /> Finding of fact: <br /> 1). Applicant proposes to add new residential garage to home while converting original <br /> garage to living space. <br /> 2). New garage will continue existing building line which previous Variance (#1475 - <br /> 7/24/86). <br /> 3). Applicant proposes to set addition into step hillside,which will reduce severity of <br /> slope of driveway. <br /> 4). South Court is a 20 foot platted right-of-way which is unimproved and Town of Dunn <br /> prefers not to vacate. <br />
