Subject to all other governmental agency approvals and conditions. <br /> Finding of fact: <br /> 1). Applicant seeks approval for an addition to a commercial building as constructed. <br /> 2). Town Board will not recommend approval of the variance or approve the Certified <br /> Survey Map until right-of-way vacation removes the structure from the right-of-way. <br /> 3). Village of Marshall has agreed to the 6' right-of-way vacation, but the proper <br /> documentation of the right-of-way vacation has not been submitted to the Dane County <br /> Land Division Review Officer and the Zoning and Natural Recources Committee. <br /> 4). The addition was constructed to replace storm and fallen-tree damage. <br /> 5). The north side lot line to be moved by Certified Survey Map approval will eliminate <br /> the request for sideyard variance. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4 - 0. <br /> 43072. Appeal by Karem, Inc. for a variance from required lot area as provided by <br /> Section 10.07(4)to permit lot line adjustment at 549 Karem Drive in the NE 1/4 NE 1/4 <br /> Section 15, Town of Medina. <br /> IN FAVOR: -- OPPOSED: --- <br /> COMMUNICATION: Town Board <br /> Long/Sayles to grant with conditions a variance of 8337 square feet from the minimum <br /> required lot area. <br /> Conditions: <br /> 1). Subject to all other governmental agency approvals and conditions. <br /> Finding of fact: <br /> 1). Applicant proposes substandard lot creation by Certified Survey Map approval. <br /> 2). R-3, Residence District requires a minimum 20,000 square feet of lot area. <br /> 3). Applicant seeks approval for an addition to a commercial building as constructed. <br /> 4). Town Board will not recommend approval of the variance or approve the Certified <br /> Survey Map until right-of-way vacation removes the structure from the right-of-way. <br /> 5).
