BOA MINUTES 11/16/00 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF NOVEMBER 16,2000 <br /> PRESENT: Klopp, Long, Sayles, Ross and Kay <br /> ALSO: Reynolds <br /> Meeting called to order by Chair Kay at 6:30 P.M. in Room 2-F City-County Building to <br /> hold public hearing as published by Class II Notice. <br /> MINUTES: SAYLES/LONG to approve minutes of 10/19 and 10/26/2000 as <br /> submitted. Motion carried 4-0 <br /> NOVEMBER PUBLIC HEARING ITEMS: <br /> #3113. (Withdrawn). <br /> #3114. Appeal by Konrad& Kay Opitz for a variance from required maximum height of <br /> boathouse as provided by Section 11.03 and 10.05(3)to permit new boathouse <br /> construction at 4521 Fox Bluff Lane being Outlot #8, Assessor's Plat of Fox Bluff, <br /> Section 5 So., Town of Westport. <br /> IN FAVOR: K. Opitz, J. Glueck OPPOSED: --- COMMUNICATION: Town <br /> of Westport <br /> SAYLES/KLOPP to deny requested variance from maximum height of accessory <br /> building to permit boathouse construction as proposed. <br /> Finding of fact: <br /> 1). Applicant proposes 40' x 32' boathouse with 12 foot sidewalls. <br /> 2). 12 foot height boathouse starting at grade 4 feet above normal high watermark <br /> requires a variance of 4 feet. <br /> 3). Boathouse height to accommodate boats on a c • <br /> r; a� and track system. <br /> 4). Applicant desires to start floor of boathouse feet above normal high watermark to <br /> allow for high water levels and ice action. <br /> 5). Adjoining property was granted a similar height request (Rosen- #2159 - 8/22/91) for <br /> modest sized boathouse. <br /> Conclusion: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried - 5-0. <br /> #3115. Appeal by Merlin Stegmann for a variance from inclusion in Noise Control <br /> Overlay District as provided by Section 10.045 to permit construction of two (2) new <br /> duplex dwellings across from 6123 and 6131 Danielle Road being Lots 12 and 13, <br /> Creekside Plat, Section 5, Town of Burke. <br /> FAVOR: M. Stegmann OPPOSED: -- COMMUNICATION: Norbert <br /> Scribner <br /> ROSS/SAYLES to deny request exclusion from requirements for noise abatement for <br /> Cov new duplex construction. <br />
