(iv <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF OCTOBER 26, 2000 <br /> PRESENT: Klopp, Long, Sayles, Ross and Kay <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. in Room#2-F City-County Building by Chairman <br /> Kay to hold Public Hearing as published by Class II Notice. <br /> KLOPP/LONG to approve minutes of September 21 and September 28, 2000 as <br /> submitted. Motion carried - 4-0 (Ross, abstain). <br /> #3111. Appeal by Barbara Kohler for a variance from required setback from road and <br /> sideyard as provided by Sections 10.13(6) and 10.17(3)to permit proposed addition to <br /> existing residence at 1130 Berlin Road in the SE 1/4 SW 1/4 Section 5, Town of Medina. <br /> IN FAVOR: B. Kohler OPPOSED: --- COMMUNICATION: Town Board. <br /> KLOPP/SAYLES to grant Variance of 16 feet from required setback to right-of-way of <br /> Berlin Road, also Variance of 8 feet from required left sideyard to permit <br /> addition/alteration of existing residence as proposed. <br /> Finding of Fact: <br /> 1). Original structure on the lot constructed in 1850. <br /> 2). Lot is 43.5 feet wide and 132 feet in depth. <br /> 3). Variance#1417 granted 11/21/85 allowed 2nd story addition to S 1/2 of residence <br /> (sideyard and setback to road). <br /> 4). Present proposal is to complete project started in 1985. <br /> 5). Encroachment into sideyard is to second story, and into setback equals 1985 <br /> Variance. <br /> 6). Required setbacks and sideyards would be reduced if lot were within recorded plat. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried. 4-1 - (Long, no). <br /> #3112. Appeal by Gregory Scalissi for a variance from required setback from road and <br /> rearyard as provided by Sections 10.16(5) and 10.05(8)to permit proposed detached <br /> garage at 3637 Natvig Road being Lot#2, Rolling Wheels, Section 28, Town of Cottage <br /> Grove. <br /> IN FAVOR: G. Scalissi,(Letter): Smerlinski & Whitmore OPPOSED: J. Dahl- <br /> (letter) COMMUNICATION: Town Board. <br />
