BOA MINUTES 8/26/99 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> August 26, 1999 <br /> PRESENT: Long, Kay, Klopp, Ross and Sayles . <br /> ALSO: Reynolds <br /> Meeting called to order at 6: 32 P.M. in Room #2-F by Chair <br /> Kay to hold public hearing as published by Class II Notice. <br /> MINUTES : LONG/ROSS to amend minutes of 7/22/99. RE: <br /> Appeal #3035 - to delete "motion carried 5-0", under <br /> CONCLUSION: #2) . <br /> LONG/ROSS to approve minutes of 7/15/99 and 7/22/99 as <br /> amended. Motion carried - 5-0 . <br /> AUGUST PUBLIC HEARING ITEMS: <br /> #3039. Appeal by Joua Vang for a variance from required <br /> sideyard as provided by Section 10. 08 (7) to permit covered entry <br /> addition at 1015 Fiedler Lane being Lot #11, Assessor' s Plat #5, <br /> Section 35, Town of Madison. <br /> IN FAVOR: No appearance OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> SAYLES/KLOPP to hold appeal until September Hearing to allow <br /> applicant to appear. Motion carried 5-0. <br /> #3040. Appeal by Mary J. Lunde for a variance from required <br /> rearyard as provided by Sections 10 . 09 (8) and 10. 091 (5) to <br /> permit repair of existing accessory building at 1538 Washington <br /> Road in the NW 1/4 NW 1/4 Section 6, Town of Albion. <br /> IN FAVOR: M. J. Lunde OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> KLOPP/LONG to grant variance of 4 feet from required sideyard to <br /> permit structural repair of accessory building as located. <br /> Finding of Fact: <br /> 1) . Original storage building, 16' x 18' which was in need of <br /> structural repair, has been enlarged by 5 feet. <br /> 2) . Repair/enlargement has been completed without necessary <br /> permits. <br /> 3) . Original building was non-conforming by lot division in <br /> 1950' s. <br /> 4) . Building utilized for storage of lawn and garden equipment. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. <br />
