BOA MINUTES 8/26/99
PAGE 3
1) . Variance preserves the zoning ordinance as much as possible
without injustice to applicant.
2) . Variance is not contrary to rights of others or to the
public interest.
Setback:
1) . Unnecessary hardship was not proven.
#3043. Appeal by Diane Reiner - Gaus / Ken' s Quick Shop for a
variance from required setback from road as provided by Section
10. 17 (2) to permit groundwater remediation building at 6145 US
Highway 12 in the SW 1/4 SE 1/4 Section 5, Town of Springfield.
IN FAVOR: D. Reiner, D. Henderson OPPOSED: ---
COMMUNICATION: County Highway
SAYLES/ROSS to grant as variance of 15 feet from required
setback to County Highway P to permit accessory structure as
requested.
Finding of Fact:
1) . Structure is a 10' x 14' gasoline and oil remediation
building.
2) . A gasoline service station has, existed on the property for
the last 60 years.
3) . Structure is anticipated to be in place for approximately 1
year, as the Department of transportation requires remediation
prior to highway construction.
4) . Building is further from right-of-way lines of both County
Highway P and USH 12 than existing buildings on property.
Conclusion:
1) . Variance preserves the zoning ordinance as much as possible
without injustice to applicant.
2) . Variance is not contrary to rights of others or to the
public interest.
