BOA MINUTES 12/16/99 <br /> PAGE 3 <br /> 1 <br /> Finding of Fact: <br /> 1) . Applicant constructed 10' x 12' storage building, under <br /> Zoning Permit ZP 1999-2707, too close to right sideyard. <br /> 2) . Required sideyard for accessory building is 4 feet minimum, <br /> while one corner is 3.5 foot to lot line. <br /> 3) . Applicant has 1. 6 acre lot that slopes to the South and <br /> several times per year may flood. <br /> 4) . Required locational survey disclosed encroachment, however <br /> work continued in violation. <br /> 5) . Applicant assumed electrical pedestal to be on or near lot <br /> line. <br /> Conclusion: <br /> 1) . Unnecessary hardship was not proven. Motion carried - 4-1. <br /> (Kay, no) . <br /> #3074. Appeal by Steven Buchholz for a variance from required <br /> setback from road and sideyard as provided by Sections 10.17 (3) <br /> and 10.09(7) to permit additions to accessory building as <br /> proposed at 17 East Badger Road in the NW 1/4 SW 1/4 Section 36, <br /> Town of Madison. <br /> IN FAVOR: S. Buchholz OPPOSED: --- COMMUNICATION: --- <br /> SAYLES/ROSS to grant variance of 20 feet from required setback <br /> to right-of-way of Granada Way also to grant variance of 7.3 <br /> feet to required right sideyard to permit alteration/addition to <br /> existing residence garage as proposed. <br /> Finding of Fact: <br /> 1) . Applicant proposes to add 2 feet in height and a 4' x 10' <br /> addition to existing garage. <br /> 2) . Existing garage is too close to own sideyard and setback <br /> from road although setback crosses property owned by others. <br /> 3) . Garage to be utilized for vehicle storage and personal <br /> workshop. <br /> 4) . Grade of Granada Way is considerably higher than grade of <br />( applicant' s lot by 10-12 feet±. <br /> Conclusion: <br /> 1) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> Motion carried - 5-0. <br /> #3075. Appeal by Gary Mobley for a variance from required <br /> setback from road and maximum height as provided by Sections <br /> 10.17 (3) and 10.123 (4) to permit accessory building as proposed <br /> at 6474 Cooke Road in the NW 1/4 SW 1/4 Section 36, Town of <br /> Mazomanie. <br /> C <br />
