BOA MINUTES 7/22/99 <br /> PAGE 4 <br /> 2) . Variance #996, granted July 23, 1981 allowed <br /> substantial remodel and additions to modest residence. <br /> 3) . When original structure was constructed setback from <br /> normal high watermark was 50 feet. <br /> 4) . New construction will extend overall width by 10.5 feet <br /> than existing. <br /> 5) . Residence upgrades include kitchen, mudroom, bathroom <br /> and study expansions. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. Motion carried 4-1 . (Long, no) <br /> #3038 . Appeal by Kelley Williamson Company for a variance <br /> from required setback from road as provided by Section <br /> 10 . 17 (2) to permit underground fuel storage tanks at 5418 <br /> Bluebill Park Drive being Lot 1 and part Lot 2, CSM #324 in <br /> the NW 1/4 SE 1/4 Section 22, Town of Westport. <br /> IN FAVOR: R. Trachtenberg, J. Bockhoff OPPOSED: --- <br /> COMMUNICATION: Town Board, County Highway <br /> ROSS/SAYLES to grant, with condition, Variance of 32 feet <br /> from required setback to right-of-way to allow underground <br /> fuel tank installation as proposed. <br /> Condition: <br /> 1) . The tanks shall be removed at the owners expense if <br /> future road improvement requires additional right-of-way. <br /> Finding of Fact: <br /> 1) . fuel tanks are underground and offer no impediment to <br /> traffic flow or safety concerns . <br /> 2) . Property is limited by setback requirements from 3 road <br /> right-of-ways which surround the project. <br /> 3) . The right-of-way width, at tank location is 150-200 feet <br /> with consideration to future expansion already included. <br /> 4) . County Highway Department recommends approval, with <br /> condition, and doesn' t anticipate highway expansion anytime <br /> soon. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest.
