tw BOARD OF ADJUSTMENT MINUTES <br /> MARCH 25, 1999 <br /> PRESENT: Long, Klopp, Kay, and Ross <br /> ALSO: Schutte, Bartlett <br /> Meeting called to order at 6:32 P.M. by Chair Kay in Room <br /> 2-F City-County Building to hold Public Hearing as published by Class II Notice. <br /> Minutes: KLOPP/ROSS to approve minutes of February 18, 1999 and February 25, <br /> 1999 as submitted. Motion carried -4-0. <br /> MARCH PUBLIC HEARING ITEMS: <br /> #3014.Appeal by Alan M. and Sue K. Brown for a variance from required sideyard and <br /> setback from normal high watermark as provided by Sections 10.08(7) and 11.03(2) to <br /> permit addition to existing residence as proposed at 4378 Jordan Drive#11 being Part of <br /> Lot 1, CSM#1681 in the NE 1/4 NW 1/4- Section 17, Town of Dunn. <br /> IN FAVOR: A. Brown, M. Hoesly OPPOSED: --- <br /> COMMUNICATION: Town Board <br /> KAY/ROSS to grant a variance from required sideyards and setback to normal high <br /> water mark to allow a two-story addition of a specific size equal to 7.5' by the width of <br /> existing house, as proposed. <br /> Finding of Fact: <br /> 1).Applicant proposes 7.5'x 26', two-story, living room and bedroom addition to existing <br /> residence in R-4 Residential, Watercress Park Condominium Plat complex. <br /> 2).Previous appeal#2010 granted 7/26/90 for a variance of 1.0'+/-from minimum <br /> required 10' right sideyard in A-1 EX. and a variance of 3.4'+/-from the 19.4' reduced <br /> average setback to the ordinary high-water mark. <br /> 3).Zoning change from A-1 EX. to R-4 in 1993 changed minimum setback between <br /> buildings "in a complex"from 10' to 20'. More than half of the existing residence <br /> encroaches into the minimum 20' separation. <br /> 4).Proposed addition will not encroach further into the existing setback to the ordinary <br /> high-water mark, will not encroach further into the existing right and left sideyards, and <br /> complies with lot coverage requirements. <br /> 5).Existing residence to be utilized on a permanent basis for four people and has no <br /> basement or garage for storage space. <br /> 5).Watercress Park Association has approved the plans and there are no objections <br /> from other Watercress Park residents. <br /> Conclusion : <br /> 1).Variance preserves the Zoning Ordinance as much as possible without injustice to <br /> applicant. <br /> 2).Variance is not contrary to rights of others or to the public interest. <br /> Motion carried 3— 1 (Long-No). <br /> #3015.Appeal by Robert C. and Susan A. Lee for a variance from required setback from <br /> road and maximum allowable percentage of improvement to a non-conforming structure <br /> as provided by Sections 10.17(2) and 10.23(2) to permit alteration/addition to existing <br /> residence at 142 County Highway N being Lot#1, CSM#7025 in the S 1/2 SW 1/4- <br /> try Section 30, Town of Albion. <br /> IN FAVOR: R.Lee OPPOSED: <br />
