BOA 6/25/98 <br /> PAGE 1 <br /> tw BOARD OF ADJUSTMENT MINUTES <br /> JUNE 25, 1998 <br /> PRESENT: Kay,Klopp,Ross, Bitzer, Long <br /> ALSO: Schutte, Bartlett <br /> Meeting called to order at 6:31 P.M. by Chair Kay to hold Public Hearing in Room 2-F, <br /> City-County Building as published by Class II Notice. <br /> MINUTES: Ross/Klopp to approve minutes of MAY 21, 1998, and to amend minutes of <br /> May 28, 1998 RE: Appeal#2940 as written Motion carried 5 - 0, to read -Motion carried <br /> 3 - 0. <br /> Motion carried 3-0. Bitzer,Long, adstain. <br /> JUNE PUBLIC HEARING ITEMS: <br /> #2943. Appeal by Rookies Food&Spirits LLC for a variance from maximum wall sign <br /> projection and area as provided by Sections 10.74(23)and 10.84(2)to permit awning sign as <br /> installed at 10267 USH 14 being Lot#1,CSM#8646 in the SE 1/4 SW 1/4 Section 15,Town of <br /> Mazomanie. <br /> IN FAVOR: B. Montelbano <br /> OPPOSED:— <br /> COMMUNICATION: TOWN BOARD <br /> Ross/Klopp to grant variance of 3.5 feet for wall sign projection. Motion carried 5-0. <br /> Cov Ross/Bitzer to deny variance from maximum allowable number of signs to permit signs as <br /> installed.Motion carried 5-0. <br /> Finding of fact: <br /> 1).Variance#2879 was granted 10/23/97 for 30 feet from required setback to centerline of <br /> USH 14 to permit 5 foot awning/overhang to existing tavern. <br /> 2).Sign permits were not obtained prior to installation of 3 signs on the awning. <br /> 3).Variance appeal#2879 mentioned signage and showed drawing of 2 signs on the awning. <br /> Conclusion: <br /> Projection: <br /> 1).Variance preserves the zoning ordinance as much as possible without injustice to applicant. <br /> 2).Variance is not contrary to rights of others or to the public interest and <br /> Number of signs: <br /> 1).Unnecessary hardship was not proven. <br /> #2944. Appeal by Ameritech,agent for Dorothy Berkan for a variance from required setback from <br /> road as provided by Section 10.17(3)to permit telecommunications equipment building as <br /> proposed located North of 2868 Dorothy Drive in the NE 1/4 NE 1/4 Section 7,Town of Dunn. <br /> Withdrawn 6/16/98. <br /> #2945. Appeal by the Town Board of the Town of Montrose to Appeal the Interpretation of the <br /> Dane County Zoning Administrator as it pertains to Governmental Uses-Sections 10.01(23h), <br /> 10.123(1)(a), 10.123(3), 10.255(2)(h), 10.26(3)and 10.26(4)of the Dane County Code of <br /> Ordinances. <br />
