ORDINANCE AMENDMENT NO. 5416 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> BURKE <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Burke be amended to include in the B-1 <br /> Local Business District the following described land: <br /> Part of Lot #1, Terrace Parklands and part of Outlots 148 and 149, Burke <br /> Assessor's Plat #1, Town of Burke, described as follows: Commencing at the <br /> North East corner of Lot #1, Terrace Parklands; thence S 13° 09' 36" East, <br /> 132.00 feet; thence N 75° 18' 40" East, 14.53 feet; thence S 13° 09' 36" East, <br /> 88.41 feet; thence N 75° 15' 24" East, 132.02 feet to the West line of Portage <br /> Road and the point of beginning of this description; thence S 13° 09' 17" East, <br /> along the West Line of Portage Road, 145.00 feet; thence S 75° 15' 24" West, <br /> 132.01 feet; thence N 13° 09' 44" West, 1.01 feet; thence S 79° 06' 36" West, <br /> 100.07 feet; thence N 13° 09' 36" West, 137.26 feet; thence N 75° 15' 24" East, <br /> 232.06 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of <br /> the Dane County Code of Ordinances. The rezoned area shall be subject to the <br /> following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> 1. The use of the property shall be limited to a tavern, one apartment and a <br /> recreational area for horseshoes and volleyball. <br /> 2. Lighting is limited to the type and wattage existing on 6/17/92. <br /> 3. Use of the volleyball area shall cease and lights shall be turned off at <br /> 9:30 PM. <br /> 4. Use of the horseshoe playing area shall cease and lights shall be turned <br /> off at 10:00 PM. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE DATE: <br /> V-4 - <br />
