ORDINANCE AMENDMENT NO. 5446 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> VIENNA <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Vienna be amended to include in the R-lA <br /> Resdiential District the following described land: <br /> Part of the NW 1/4 NW 1/4 Section 13, Town of Vienna described as follows: Lot <br /> #2, CSM 398 found in Volume 2, Page 174 of Certified Sruvye Maps Dane County <br /> Register of Deeds Office. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. A chain-link or similar woven-wire fence shall be installed and <br /> maintained along the West property line of the proposed Westerly lot. <br /> Said fence shall run from the Right-of-way of Hahn Road, Southerly along <br /> the West lot line a distance of 290 feet, to provide a barrier along the <br /> rear lot lines of Lots 17 and 18, Hillcrest Acres Plat. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> i�1.J <br /> EFFECTIVE DATE: - <br />
