Appeal 3568 by Dean & Kimberly Vogel for variance from minimum required setback from road as <br /> provided by Section 10.17(2), Dane County Code of Ordinances, to permit addition to existing single- <br /> family residence as proposed at 1271 County Highway H, in the SW 1/4 NE 1/4 Section 09, Town of <br /> Perry. <br /> OWNER: Dean & Kimberly Vogel <br /> AGENT: None <br /> LOCATION: 1271 County Highway H <br /> ZONING DISTRICT: RH-4 Rural Homes <br /> COMMUNICATIONS: <br /> 05/13/2009 Email from Mary Price, Clerk, Town of Perry: Town Board Action on 05/12/2009: <br /> "[R]ecommend approval of a setback variance for a residential addition as presented by Dean Vogel." <br /> 06/18/2009 Email from Pam Dunphy, Assistant Commissioner, Dane County Highway Dept.,: "No <br /> apparent conflict with County Highway. If improvements are allowed, to protect the County's future interest, <br /> a condition stating "improvements made within the setback shall be removed at the owners' expense if <br /> future highway needs require additional right-of-way" should be included in the variance." <br /> Facts of the Case: <br /> Existing: <br /> • Vogels own 127+- acres, with 100+-zoned A-1 EX and 27+-zoned RH-4 Rural Homes. <br /> • Rural Homes portion rezoned in 1987 (Petition 3999) includes house and farm buildings. <br /> • Existing 26'x52' house built "more than 100 years ago," according to Vogel. <br /> • Zoning Permits were issued for 1) addition with bedroom in 1999 and 2) 25'x28' detached garage in <br /> 2002. <br /> Proposed <br /> • Extend kitchen to north, replacing existing porch and part of existing wrap-around deck. <br /> • 15'x17' addition would not extend closer than finished front wall of house, and would replace an existing <br /> shed-roofed porch on the north side of the house. <br /> Zoning Notes: <br /> • Intermittent stream to west is more than 300 feet away from house. <br /> • *Front (east side) of house is not exactly parallel to CTH ROW, so addition would be slightly closer than <br /> existing northeast corner of house, which is 35.6 feet from ROW. <br /> • County Highway H ROW is 66 feet wide in front of the Vogel house and outbuildings. The ROW <br /> expands to 83 feet wide south of the buildings. It appears that the physical roadway is located closer to <br /> the west ROW line than to the east ROW line. <br /> VARIANCE REQUESTED: Purpose: Allow addition/alteration to existing house <br /> Setback from Road Variance: <br /> Minimum setback from right-of-way required: 42 feet from County Highway H ROW <br /> Proposed setback from CTH H ROW line: 35.6 feet more or less* <br /> VARIANCE NEEDED: 6.4 feet more or less <br />
