RESTRICTIONS <br /> 1. WHEREAS, is/are <br /> the owner/s of the following described land in the Town of <br /> Dane County, Wisconsin, to-wit: <br /> 2. Part of the SW 1/4 NE 1/4 Section 16, Town of Pleasant Springs described <br /> as follows: Lot #1, CSM 6632 found in Volume 32, Page 300 of Certified <br /> Survey Maps Dane County Register of Deeds Office. <br /> 3. NOW, THEREFORE, in consideration of the mutual benefits passing to and <br /> from the owner and those who may hereafter purchase said land and the <br /> parties named as beneficiaries of these restrictions, the following <br /> restrictions are hereby imposed: <br /> A. Use of the property will be limited to the following: <br /> 1. Storage or parking of a maximum of 6 trucks. <br /> 2. Warehouse uses <br /> 3. Specified uses as permitted by the following sections of the zoning <br /> ordinance, C-1 Zoning District, in effect as of September 1992; <br /> a. §10.13 (1)(a), Retail and service uses including but not limited to <br /> grocery stores, drugstores, hardware stores, appliance and furniture <br /> stores, barbershops and beauty shops without limitation as to size. <br /> b. 10.13 (1)(c), Warehousing and storage incidental to a permitted use on <br /> the premises. <br /> c. 10.13 (1)(d), Medical, dental and veterinary clinics. <br /> d. 10.13 (1)(e), Banks, offices, office buildings and condominium office <br /> buildings devoting not more than two (2) floors to office space. <br /> e. 10.13 (1)(f), Utility services. <br /> f. 10.13 (1)(i), Distribution centers and wholesale businesses. <br /> g. 10.13 (1)(j), Woodworking shops, machine shops, manufacturing and <br /> assembly plants. <br /> h. 10.13 (1)(k), Bicycle sales and service. <br /> i. 10.13 (1)(1), Rental businesses, except for motor vehicles and <br /> construction machinery and equipment. <br /> j. 10.13 (1)(o), Sales and repair of lawn and garden equipment. <br /> These restrictions shall constitute covenants running with the land and <br /> shall be binding upon all parties now owning any part of said land, their <br /> successors, heirs and assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> 4. The restrictions provided for herein shall be enforceable at law or <br /> equity against any party who has or acquires an interest in the land <br /> subject to the restriction by the following parties who are named as <br /> grantees, promisees and beneficiaries with enforcement rights: <br /> (a) The County Government of Dane County, Wisconsin provided that the <br /> lands are under the jurisdiction of zoning ordinance of said County <br /> at the time the enforcement action is commenced; and <br />
