Cheney, agent for Karam, Inc. to change <br /> the zoning from the R-3 Residential and C-2 Commercial district to the R-1A <br /> Residental, C-2 Commercial and R-4 Residential district. <br /> Location: 528 Maunesha Drive Section 15, NE NE Town Medina Area: 7.8 <br /> more or less Acres <br /> Provosed use: Correct zoning boundary and use violations. P.E.D. Yes. <br /> ANALYSIS: <br /> #4956. Rezone will provide zoning compliance for existing uses. The imposed <br /> restrictions will limit the use to that existing at the present time. <br /> CONCERNS EXPRESSED AT/AFTER PUBLIC HEARING; <br /> STAFF COMMENTS: <br /> R.P.C. - Petition 4956. The purpose of this Is to correct zoning violations; a <br /> site plan has been submitted Indicating existing buildings, but there is <br /> no Indication of future building plans. <br /> The R-1A and C-2 changes reflect building and setback encroachment . <br /> However , the R-4 rezoning would allow an unacceptably high density o. <br /> residential use for an unsewered area. The R-4 district allows one <br /> dwelling unit per 5,000 sq. ft . of lot area. This Is four times the <br /> density allowed by the existing R-3 zoning, which requires a 20,000 sq. <br /> ft . lot size. The Groundwater Protection Plan recommends a minimum lot <br /> size of 1-1/2 to 2 acres for unsewered development . <br /> In addition, the residential change area is located between two C-2 <br /> heavy commercial-Industrial use areas. The policy question Is whether <br /> any more residential development should be allowed In this area. <br /> Clearly the R-4 zoning requested would allow a much higher density of <br /> development than is compatible In an unsewered area. <br /> The site plan shows three residential units in the area to be rezoned R-4 <br /> Multi-family consisting of one single family dwelling and one duplex. A <br /> condition of the rezoning is that there be no more than the existing units on <br /> this parcel. Thus, concerns for higher density development are addressed by <br /> this condition. Any proposal to add further units will have to go through the <br /> rezoning process to amend this condition. <br /> • <br />
