- DECLARATION - <br /> • 1. WHEREAS, <br /> • is/are the owner or owners of the following described land in the Town <br /> of , Dane County, Wisconsin, to wit: <br /> Part of the SW 1/4 NE 1/4 Section 9, Town of Deerfield described as <br /> follows: Commencing at the East quarter corner of said Section 9; <br /> thence West, 1540.45 feet along the South line of the said NE 1/4; thence <br /> N 00° 11' East, 380.65 feet; thence N 89° 49' West, 330.00 feet to the <br /> West right-of-way line of Pheasant Hill Drive; thence N 00° 11' East, <br /> 909.75 feet along the said West line of Pheasant Hill Drive to the South <br /> right-of-way line of Graffin Road and the point of beginning of this <br /> description; thence S 00° 11' West, 400.00 feet along the said West line <br /> Pheasant Hill Drive; thence N 89° 49' West, 110.00 feet parallel with the <br /> said South line of Graffin Road; thence N 00° 11' East, 400.00 feet <br /> parallel with the said West line of Pheasant Hill Drive to the aforesaid <br /> South line of Graffin Road; thence S 89° 49' East, 110.00 feet along the <br /> said South line of Graffin Road to the point of beginning. <br /> 2. WHEREAS, the said owner of the above-described property now wishes to <br /> make certain declarations as to the above-stated property to provide <br /> notice within the chain-of-title to the public and any successors in <br /> interest to this real property; <br /> 3. NOW, THEREFORE, let it be known to the public generally throughout Dane <br /> County and elsewhere as well as anyone acquiring title or an interest in <br /> the above-stated property that it is intended to provide clear notice by <br /> means of this "Declaration" as to the following: <br /> A). Present owner/s acknowledge and by means of this notice assure that <br /> successors in interest will be informed of the fact that a <br /> greenhouse agri-business exists on the adjacent property which may <br /> have a potential to disturb the proposed residential use of the <br /> above listed property. <br /> This declaration shall run with the land and shall advise all parties now <br /> owning any part of said land, their successors, heirs and assigns, and <br /> all parties holding under them unless, pursuant to paragraphs 4 or 5 of <br /> this instrument, said declaration is amended or terminated. <br /> 4. The declaration set forth in paragraph 3. above may be amended in the <br /> following manner: <br /> A). A written petition calling for the amendment of the declarations may <br /> be made by the persons who are, at the time of the petition, owner/s <br /> of the lands subject to the declaration. Such petition shall be <br /> submitted to the Dane County Clerk who shall refer the petition to <br /> the Dane County Zoning & Natural Resources Committee(or successor <br /> committee) which committee shall schedule and hold a public hearing <br /> on the petition in the same manner as public hearing for zoning <br /> amendment petitions are noticed and scheduled. Following such <br /> hearing, the committee shall issue a written report on the petition <br /> to the County Board of Supervisors which shall, by majority vote, <br /> approve or reject the petition. If approved, the petitioner/s shall <br /> draft the amendatory covenant instrument, have same executed by the <br /> owner/s of the lands subject to the declarations and record same. <br /> - 1 - <br />
