DANE COUNTY ORDINANCE AMENDMENT NO: 9798 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Christiana. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps <br /> of the Town of Christiana be amended to include in the RH-1 Rural Homes and A-2(4) <br /> Agricultural district(s) following described land: <br /> PETITION NUMBER: 9798 <br /> Part of Section 18, Town of Christiana described as follows: <br /> LOT 1: A-1EX TO RH-1 <br /> Parts of the NE 1/4 of the SW 1/4 of Section 18, T.6N., R.12E., Town of Christiana, <br /> Dane County, Wisconsin further described as follows: Commencing at the Southeast Corner of <br /> the NE 1/4 of the SW 1/4; thence N00°58'02"E along the East line thereof, 211' to the point of <br /> beginning of this description; thence N89°59'42"W, 416'; thence N00°53'47"E, 416'; thence <br /> S89°59'42"E, 416'to the aforesaid East line; thence S00°58'02"W along said East line, 416' to <br /> the point of beginning. The above described being subject to a right of way over the Easterly 33' <br /> and containing 3.6 acres more or less to the right of way. <br /> LOT 2: A-1EX TO A-2(4) <br /> Parts of the NE 1/4 of the SW 1/4 and the SE 1/4 of the SW 1/4, all in Section 18, T.6N., <br /> R.12E., Town of Christiana, Dane County, Wisconsin further described as follows: Beginning at <br /> the Southeast Corner of the NE 1/4 of the SW 1/4;thence S00°58'02"W, along <br /> the East line thereof, 340' to the North line of I-39; thence N89°06'13"W along said <br /> North line, 227'; thence continue along said North line,N43°34'48"W, 625'; thence <br /> N0O°41'54"E, 510'; thence S89°59'42"E, 250'; thence S00°53'47"W, 416'; thence <br /> S89°59'42"E, 416'to the aforesaid East line; thence S00°58'02"W, along the East line, <br /> 211' to the point of beginning. The above described being subject to a right of way over <br /> the Easterly 33' and containing 7.9 acres more or less to the right of way. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County <br /> Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the owner or <br /> owners of the land record the following restriction(s) on said land: <br /> 1. Deed restrict the A-2(4) parcel prohibiting residential development. <br /> Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as well as the <br /> owners of land within 300 feet of the site. Failure to record the restriction(s)will cause the <br /> rezone to be null and void.
