Wisconsin Department of Natural Resources <br /> Air Pollution Control Permit Application <br /> • <br /> • <br /> Introduction <br /> Section 144.391, Wisconsin Statutes, and Section NR 406.04, Wisconsin Administrative Code, <br /> require all stationary air pollution sources to have an air pollution control permit from <br /> the Department of Natural Resources unless the source is exempt from the requirement to <br /> obtain an air permit. The permit must be obtained by new sources prior to construction, <br /> modification, reconstruction, relocation or replacement and operation. Any person who <br /> violates these sections or any permit or special order issued under these sections can be <br /> subject to forfeitures of not less than $10 or more than $25,000 for each violation. Each - <br /> day of continued violation is a separate offense. <br /> An application for a permit containing plans and specifications for the source must be <br /> submitted to the Department. The plans and specifications are then reviewed by Department <br /> staff to verify that the air pollution source will comply with all applicable rules and <br /> statutory requirements and to determine its impact on air quality. <br /> The time and effort required by Department staff to adequately review an application for <br /> an air pollution control permit is dependent on the completeness of the application. To <br /> expedite the review process, application forms are provided. Complete those forms which <br /> are appropriate for each air pollution source which you propose to construct, modify, - <br /> reconstruct, relocate, or replace. <br /> Review of an air pollution control permit application typically takes 90 to 120 days after <br /> a complete application is received. Two methods are available to expedite the review <br /> process. A pre-application meeting with Department representatives can determine the <br /> information required for a complete application. Secondly, state statutes require the <br /> review process to include a public comment period and if warranted, a public hearing. <br /> Review of a permit application can be expedited if the applicant agrees to publish the <br /> necessary notices for public comment and hearing. <br /> Section NR 410, Wis. Adm. Code, requires that beginning May 1, 1988, $500 be submitted <br /> with a permit application. This $500 is refundable in only certain instances, but the <br /> $500 will be applied to the final permit application fee. The balance of the permit <br /> application fee is due if a permit is issued or other action as specified in the rule is . <br /> taken. This fee supports the programs developed to review permit applications. Fee <br /> schedules are available with air permit application forms. <br /> Additional permit application forms can be obtained from the office listed below. <br /> Questions regarding completion of these forms or applicability of the air pollution <br /> control permit requirements can also be referred to this office. <br /> Address three copies of all completed air pollution control permit application forms or <br /> prevention of significant deterioration permits, two copies of all completed air pollution <br /> control permit applications forms for minor sources or minor modifications to major <br /> sources, and all related questions to the Department of Natural Resources, Southern <br /> District Air Program, 3911 Fish Hatchery Road, Fitchburg, WI 53711, phone (608) 275-3291. <br />
