April 4, 1991 7 Ms. Sharon Bisgard - Chair Dane County Zoning and Natural Resources Committee City-County Building Madison, WI 53707 Mr. Harland Dahlk - Vice Chair Dane County Zoning and-Natural Resources Committee City-County Building Madison, WI 53707 RE: Rezoning Petition - #4990 Dear Ms. Bisgard and Mr. Dahlk: The purpose of this-letter is to inform you that I am requesting that the above-captioned petition, which I filed on behalf of the Bernard Zwettler Estate, be amended in two respects. These amendments stem from my desire to accommodate concerns expressed by Mr. John Rowley, an owner of property adjacent to the parcel subject to this petition. I have indicated in several recent discussions with Mr. Rowley that I am willing to accept a deed restriction on the RH-3 parcels created by this petition which recognize the operation of his salvage yard prior to creation of these parcels. I have also indicated I am willing to accept a deed restriction on any RH-3 parcel contiguous to his property which prohibits the construction of any building within 150 feet of his property line. Accordingly, I respectfully request that the Zoning and Natural Resources Committee of the Dane County Board give consideration to approval of the following amendments to petition #4990: 1. Amend to include a condition pursuant to ss 10. 255 (3) Dane County Code of Ordinances that a statement recognizing the existence of the adjacent salvage yard operation and the owner's rights to continue said operation be recorded on the face of the title for any parcels created by division of this property which are zoned RH-3 Residential. 2 . Amend to include a condition pursuant to ss 10 . 255 (3) Dane County Code of Ordinances that a statement prohibiting the construction of any buildings within
